A lady bird deed can be a great probate-avoidance tool.

But it doesn’t:
• Control when your children inherit
• Protect the property from a child’s divorce
• Redirect it to grandchildren if something happens

It transfers automatically.

🚨 News flash: A will does not avoid probate. It simply tells the court who gets what.

A trust, on the other hand, keeps your assets out of court entirely. Because everything is handled privately by the successor trustee you name, not a judge.

If avoiding probate is the goal, a will alone won’t get you there.

This is why estate planning is more than “just a will.”

I see this all the time — parents add their child to the house deed now to “avoid probate” later… but no one talks about the TAX side.

When you’re added to the deed during your parent’s lifetime, you usually take their original purchase price as your tax basis. That means when the home is sold, capital gains can be based on decades of appreciation 😬

But if you inherit the property after they pass, you typically get a step-up in basis to the home’s value at date of death — which can mean WAY less capital gains tax when you sell.
Good intentions + bad strategy = expensive surprise. Planning isn’t just about avoiding probate… it’s about avoiding unnecessary taxes too.

Before adding someone to your deed, talk to an estate planning attorney AND a CPA.

I say this with love: waiting to start probate can cost you control.

I met with a client a while back who knew probate was needed… but decided to hold off. Fast forward to now — he’s ready to move forward, but someone else already opened the probate case.

That means:
❌ He’s not the petitioner
❌ He’s not driving the process
❌ We’re stepping in as a beneficiary instead of leading
And when you’re not the one who files first, you’re automatically playing catch-up.

If you know probate has to be done, getting ahead of it can mean:
✔️ Choosing the attorney you want
✔️ Staying in control of the timeline
✔️ Avoiding unnecessary complications and conflict

Probate doesn’t get easier with time — it usually gets messier.
If you’re “waiting for the right time,” this is your sign. 💼⚖️

Everyone thinks trusts are just for the ultra-wealthy… until real life enters the chat.

Here are 3 situations where a trust isn’t fancy — it’s necessary:

👶 Minor children – A trust lets you control who manages the money, how it’s used, and when your kids receive it. Otherwise, a court decides.

💍 Married children – An inheritance left outright can become vulnerable in divorce, lawsuits, or bad financial decisions. A trust can help keep it protected.

👨‍👩‍👧‍👦 Blended families – When both spouses have children from prior relationships, a trust makes sure your kids are provided for — not accidentally disinherited later.
