Why a Preliminary Probable Cause Hearing Matters in Mississippi Felony Cases

When someone is arrested for a felony in Mississippi, one of the most critical — and often misunderstood — stages of the case is the preliminary probable cause hearing.

This hearing is where:

▪️ A judge decides whether a crime was committed
▪️ The State must meet a preponderance of the evidence standard
▪️ Bond may be set or reduced
▪️ Weak cases can be dismissed early
▪️ Key testimony can be locked in for future trial use

In serious cases, my office routinely recommends hiring a court reporter so every word of testimony is preserved. A full transcript can later become one of the most powerful tools in defending a felony case — especially when the hearing is held in justice or municipal court.

On June 19, 1865, enslaved people in Galveston, Texas finally received word of their freedom—more than two years after the Emancipation Proclamation. Juneteenth is a reminder that justice must be fought for—relentlessly and without pause.
