A valuable intangible that sprang from your mind is your intellectual property. You have a right to protect it so other people can not "counterfeit" or improperly profit from your creative efforts. A trademark is a brand identifier -- a brand name, slogan, or logo. Trademarks can be registered when your product is commerce-ready. It is a process that costs a few hu

ndred to a few thousand dollars per mark, and takes a few months. A patent is a tangible "gadget" or a method, which can include software or an app. You can file a patent application as soon as you can fully describe how the product is made and used. The patent process has a lifetime cost of about $10,000 and takes a few years. It is a big commitment that I help break into manageable steps. My experience is in the area of securing visas, green cards, and citizenship. The most common way to gain admission is through family. Visas and green cards are also available to students, workers, entrepreneurs, and investors. If you fit one of these categories, you may qualify for an F-1, J-1, E-1, E-2, H-1, or even an EB-5 visa. Though I do not specialize in issues of illegal crossings, arrests, and deportation, I have a close colleague who is an expert in "crimmigration" law and can quickly refer your case to her.

I get lots of questions about how to protect a new idea before a patent is available. The answer is to protect yourself with contracts (non-disclosure agreements) though they have their limitations. Here is a good article on the subject.

I've recently spoken to a couple of clients who "have heard" that they should register their companies in Delaware. This article presents pros and cons. In sum, I have to agree with the takeaway point that small companies should stick to registering in their own home state.

Before deciding where to incorporate your business, take some time to understand the advantages and drawbacks involved in setting up your business in Delaware.

Super Bowl Trademarks

For the legally curious, here's a list of all the NFL "Super Bowl" trademark registrations that I can find. Essentially, (unless you're the NFL), you can't brand any of these enumerated goods or services for sale with the term "Super Bowl".

If you're just having some friends or relatives over to watch the Super Bowl on CBS (no cover charge) then it's fine to announce it as a "Super Bowl" party. It's when you use the term in commerce that you have to be careful, because the NFL protects this mark vigorously. The parties that get into the most trouble are those (1) charging admission for a viewing party or (2) making / selling their own merchandise marked with "Super Bowl" or any team name.

Interestingly, the earliest "Super Bowl" trademark registration was for a board game! That application dates to 1966, slightly before Super Bowl I.
