Non-probate transfers are often used to simplify estate administration, but they can also create complex legal issues if not carefully planned. This chapter provides a practical overview of how assets pass outside of probate and the implications for estate planning and administration.

This chapter covers:
-Joint tenancy and survivorship rights, and how assets transfer at death
-The rules governing multiple-party accounts and POD (payable-on-death) designations
-How ownership is determined during life and at death, including the “net contribution” rule
-Key considerations for non-probate transfers, including TOD deeds and beneficiary designations
-Practical insights from Nebraska case law on disputes involving joint accounts and intent

We are grateful for Bonnie Boryca, of Erickson Sederstrom PC, LLO. Bonnie began volunteering in 2025 with VLP's community-based legal clinic at the NAACP clinic in Omaha. Bonnie has used her extensive legal knowledge to help low-income Nebraskans who find themselves involved in the civil court system. Bonnie has shown respect and understanding with all of the people she has helped. Additionally, Bonnie demonstrates excellent communication skills to ensure self-represented litigants understand the process and their path forward.
