How do you get to a successful mediation?
It starts long before everyone sits down at the table.
After the 558 process, inspections, document exchanges, and claim evaluations, the goal is to make sure the key pieces are accounted for:
The alleged defects are clearly documented.
Liability and damages have been evaluated.
Insurance coverage issues are understood.
The right decision-makers have the information and authority needed to negotiate.
Each party understands the risks of continuing the dispute.
A successful mediation depends on preparation, realistic expectations, and a strategy that gives the insurance adjuster, and sometimes their supervisor, what they need to evaluate a resolution.
Getting everyone “squared away” does not happen by accident. It takes clear documentation, careful analysis, and a plan for addressing the issues that could keep the case from settling.
