When creating an estate plan, many people focus on who they trust most.

While trust is certainly important, serving as trustee involves much more than good intentions.

A trustee may be responsible for managing assets, keeping records, communicating with beneficiaries, making distribution decisions, and carrying out the instructions outlined in a trust document.

The role can last for years and sometimes even decades.

Before naming a trustee, consider whether the person you've selected has the time, temperament, and ability to manage those responsibilities successfully.

In some situations, a family member may be an excellent choice. In others, a professional fiduciary or corporate trustee may be better positioned to serve in that role.

Ultimately, the goal is to choose someone who can effectively carry out your wishes and help protect the people you care about most.

One piece of advice Attorney Desiree F. Rivera often shares with clients is simple: revisit your estate plan periodically.

Sometimes clients can be surprised to learn their trusts contain specific provisions they have either forgotten about or no longer want. In some cases, those provisions had been drafted years earlier when family circumstances and goals looked very different.

That doesn't necessarily mean anything was done incorrectly. It simply reflects the reality that life changes.

Children become adults. Families grow. Financial situations evolve. Priorities shift.

Your estate plan should continue to reflect your current wishes.

If it has been several years since you've reviewed your trust, it may be worth sitting down with experienced estate planning counsel to confirm your documents still accomplish exactly what you intend.
