Attorneys Erin Mindoro Ezra, Heather C. Whitmore, and Ryan T. Fitzgerald examine a growing reality for employers: in 2025, more wage-and-hour class and collective actions were filed than any other category of complex litigation nationwide.

A recent $233 million settlement involving The Walt Disney Co. serves as a powerful reminder that wage-and-hour exposure is not only increasing — it is often uninsured. As the article explains, traditional policies such as Commercial General Liability (CGL) and Employment Practices Liability Insurance (EPLI) typically exclude wage-and-hour liabilities, and even when endorsements apply, coverage is often limited to capped defense costs only.

The takeaway: With limited insurance solutions available, employers cannot rely on insurance to manage wage-and-hour exposure. Proactive compliance and experienced counsel are more critical than ever.
