A catastrophic-injury referral should add capability without subtracting trust.

The referring lawyer may have spent years earning the client's confidence. Co-counsel should protect that relationship while adding what the case now requires: litigation funding, specialized experts, trial preparation, and the capacity to carry a complex matter through discovery and, if necessary, verdict.

That is how Tony and Andrew Baratta approach referred and partnered cases. Referring attorneys stay informed, communication stays open, and the client is not made to feel passed from one office to another.

The client should feel that the legal team became stronger, not that the relationship changed.

The decision to involve co-counsel is not about giving a case away. It is about building the team the client's case demands.

Resources can be shared.
Responsibility cannot.

After a product causes a serious injury, the most important evidence is often the first thing thrown away: the product itself.

Without it, even a strong case can vanish. One driver, burned over half his body in a truck fire, nearly lost his, until the truck was preserved, a defective fuel-tank design was proven, and the case settled for over $8 million on the eve of trial.

Rule one in any catastrophic injury case: preserve the evidence early. Swipe through, then read the full breakdown: https://www.barattalawfirm.com/2026/06/05/the-most-significant-step-in-a-product-liability-case/

Brake failure is rarely a one-second story.

Brake Safety Week runs August 23–29, with inspectors focusing this year on commercial-vehicle drums and rotors. A truck may fail to stop in a moment, but the cause can reach back through months of inspections, repairs, driver reports, and maintenance decisions.

After a serious truck crash, the investigation asks different questions of different parties:

Who owned the vehicle?
Who inspected it?
Who was responsible for maintenance?
Were defects reported?
Was the truck kept in service anyway?

A roadside citation is only one piece of the picture. The vehicle itself and the records behind it may show whether the failure was sudden, missed, or allowed to continue.

A brake defect lasts seconds on the road. Its paper trail may reach back months.

The largest number in an injury case is often the one no calculator can reach.

Pain and suffering is the hardest part of a case to prove, and usually the most important. Here is the three-part method our team uses to show a jury the full weight of what a catastrophic injury takes from a person's life.

A drunk-driving case can have two scenes.

The first is the road. The second may be the place where the driver was served.

The national Drive Sober or Get Pulled Over enforcement campaign begins today. Prevention comes first: plan the ride before the first drink.

When a fatal crash follows visible intoxication, the investigation may extend beyond blood-alcohol evidence. Receipts, time-stamped video, witness observations, the pace of service, and what staff could see may become central to whether Pennsylvania law was violated.

In one case our team tried, a jury returned a $3 million verdict against an impaired driver and the bar that had overserved him.

That does not make every bar responsible for every patron. It shows why the timeline before the keys were picked up can matter as much as the collision itself.

Accountability may begin before the engine does.

A red light is not a legal pause button for handheld phone use in Pennsylvania.

Paul Miller’s Law applies while a vehicle is moving and while it is temporarily stopped by traffic, a stop sign, or a signal. Since June 5, 2026, a conviction carries a $50 fine, plus court costs and other fees. Hands-free use and emergency calls remain permitted.

The civil-law point is equally important: a violation may be evidence of distraction, but a crash claim still requires proof that the conduct helped cause the collision and the resulting harm.

That distinction matters.

The law prohibits the behavior. The case must connect the behavior to the impact.

A red light may stop the car. It does not suspend the driver’s duty to pay attention.

A bad outcome is not automatically malpractice. The line is crossed only when four connected questions are all answered yes.

We tried a case that turned on exactly that. A bile leak after surgery is a known complication. Dismissing the symptoms, delaying the diagnosis, and letting an infection cause severe harm is what made it a case. A Philadelphia jury returned a $4 million verdict.

The complication started the problem. The failure to respond became the case.

He pulled over to help a stranger change a flat tire. He left that roadside having lost both legs above the knee.

There is no version of that day anyone plans for. What our team could do was make sure the years after it were not spent worrying about money on top of everything else. The case took nine years and involved four defendants. It ended with a settlement that guarantees him income for life and pays for the lifetime of medical care his injuries will require.

A number in a headline is easy to read past. Behind this one is a man who stopped to help someone he had never met, and a family who can now plan a future instead of fearing it.

That is what this work is really for.
