Dog bites are often blamed on breed.

That can distract from the owner’s responsibility.

In the cases Baratta Law has handled, recurring factors included poor socialization, unsafe training, dogs being allowed to escape and children being left unsupervised.

Breed may influence the severity of an injury. It does not replace an owner’s responsibility to properly train, secure and supervise the dog.

A safer dog starts with a responsible owner.

October is National Pedestrian Safety Month.

According to NHTSA, 7,080 pedestrians were killed and more than 71,000 were injured in traffic crashes in 2024.

Drivers should slow down before turning, scan the entire crosswalk and take extra care at night or in poor weather. Pedestrians should use crosswalks where available, remain alert and wait until vehicles have fully stopped before crossing.

Baratta Law obtained a $2.3 million recovery in a case involving a pedestrian struck in a crosswalk by a right-turning delivery truck. Surveillance footage and accident reconstruction showed that the driver should have seen the pedestrian if he had not been distracted.

The case is a reminder that camera footage, witness information and sight-line evidence should be preserved quickly after a collision.

Slow down. Look before turning. A few seconds of attention can prevent a life-changing injury.

An insurer does not need to prove fraud to make the accusation expensive.

It may identify similarities across treatment records, label the care “predetermined,” and use the threat of litigation as leverage before the treatment of any individual patient is properly examined.

But a pattern may justify a question. It does not establish whether one patient’s treatment was reasonable and necessary, and it does not prove fraud.
