What happens when a Collaborative matter reaches an impasse?

Reaching disagreement doesn't necessarily mean the Collaborative Process has failed or that the parties must immediately turn to litigation.

A private judge can sometimes provide another option.

A private judge may help evaluate a specific legal issue, make a decision on a narrowly defined dispute, conduct a private hearing, or provide guidance when negotiations reach an impasse.

The goal isn't to turn a Collaborative matter into litigation. Instead, private judging can be used selectively as another tool in the Collaborative toolbox, potentially allowing parties to maintain greater control over the process while addressing a difficult issue.

But there are important questions to consider: What should the private judge's role be? What limitations should apply? And how should the Collaborative professionals work together when a private judge is involved?

Collaborative Divorce is designed to create a respectful, problem-solving environment—but that doesn’t mean everyone gets everything they want.

So, what should a client realistically expect?

✔️ A meaningful opportunity to be heard
✔️ Complete and accurate information
✔️ Respectful communication
✔️ Good-faith negotiation
✔️ Creative solutions tailored to the family
✔️ A focus on children’s needs—not using them as leverage

At the same time, clients should expect that there may still be disagreement, difficult conversations, and compromise along the way.

The goal isn't to eliminate conflict. It's to approach conflict differently and work toward an informed, durable agreement.
