That tip was left for you. In California, it stays with you.
Under Labor Code section 351, every gratuity is the sole property of the employee it was paid to. Your employer cannot take it, keep any part of it, or count it against your wages. Owners and managers cannot share in the tip pool either.
Paid by card? The full tip is still yours, and your employer cannot deduct the credit card processing fee from it. Tips left on a card must be paid to you no later than the next regular payday.
If your tips are being skimmed, pooled with management, or docked for fees, save your pay records and reach out. You may be owed far more than you think.
