That tip was left for you. In California, it stays with you.

Under Labor Code section 351, every gratuity is the sole property of the employee it was paid to. Your employer cannot take it, keep any part of it, or count it against your wages. Owners and managers cannot share in the tip pool either.

Paid by card? The full tip is still yours, and your employer cannot deduct the credit card processing fee from it. Tips left on a card must be paid to you no later than the next regular payday.

If your tips are being skimmed, pooled with management, or docked for fees, save your pay records and reach out. You may be owed far more than you think.

Signing an arbitration agreement does not automatically close the courthouse door.

Many employers make arbitration agreements a condition of employment. But a signed agreement is not the end of the analysis. Arbitration agreements can be challenged as unconscionable under California law, including where the terms are one-sided, the fees are unaffordable, or the employee had no meaningful choice. The specific language in your agreement matters.

If you have an employment claim and you’re concerned that an arbitration agreement blocks you from pursuing it, that concern may be premature. Enforceability depends on how the agreement is written and the facts of your situation.

Most California workers have been earning paid sick leave since 2015 — and many still don’t know they can use it without being punished.

Under Labor Code § 246, most employers in California must provide at least 5 paid sick days per year. You can use them for your own illness, a family member’s medical care, or if you or a loved one are dealing with domestic violence, sexual assault, or stalking. Your employer cannot require you to find a replacement, take a full day when you only need a few hours, or retaliate against you for using what you earned.

If you were denied sick leave, had hours cut after calling out, or were fired for using paid sick time, that is a potential claim. Retaliation for using protected leave is taken seriously under California law.

It’s Election Day in California. If you don’t have enough time to vote outside work hours, your employer is legally required to give you up to two hours of paid voting time. California Labor Code § 14000 is clear on this.

Your employer cannot require you to use vacation or PTO for voting. All they need is a reasonable request. Give two working days’ notice if possible, and they can specify when you take the time during your shift.

If your employer denies you paid time off to vote, you may have a legal claim. Know your rights.
