FAQ: What Is Discovery?

Discovery is the stage in a lawsuit at which each party has the right to get documents and factual information from the other that is relevant to the case.

HOW IT WORKS

Information is gathered through several formal tools:

* Requests for production – demands for documents, emails, and records
* Interrogatories – written questions that must be answered under oath
* Requests for admission – asking the other side to admit or deny specific facts
* Depositions – sworn testimony taken in person before trial

WHY SCOPE MATTERS

In Texas state courts discovery goes beyond the scope of what is directly relevant and includes information that is reasonably calculated to lead to admissible evidence; a document which could never itself be presented to a jury may still point to one that can and thereby be able to alter the course of a case.

NOT EVERY CASE NEEDS EXTENSIVE DISCOVERY

A simple unpaid debt usually involves only a small amount; in the case of a former employee taking proprietary software to set up a competing business, however, it is often necessary to carry out thorough and carefully focused discovery in order to prove the claim.
