Appellate win at the Fifth Court of Appeals in Dallas.

The court reversed the trial court's judgment for our clients, Copper Creek Distributors, Inc. and Jose Doniceth Escoffie:

Rendered judgment that Mr. Escoffie is not the alter ego of CCDI
Take-nothing judgment on tortious interference
Held the spoliation jury instruction was an abuse of discretion
Reversed damages as speculative and legally insufficient
Remanded remaining claims for new trial

Damages require evidence. Alter ego requires proof.

Most business disputes are decided before anyone files suit — the day the entity was formed and the contract was signed.

Business formation and entity selection. Purchase and sale of businesses and real estate. Contract drafting, review, and negotiation.

We build transactions from a litigator's perspective, because we know how these documents are read when they're challenged.

Start it right.

An appeal is not a second trial.

No jury. No new evidence. A cold record and one question — did the trial court get the law right?

That takes a different skill set: preserved error, standards of review, and briefs written for judges who read hundreds of them.

We handle civil appeals in state and federal courts, for appellants and appellees alike. Strategy and briefing. Oral argument. Petitions for review. Post-judgment motions.

Whether you're challenging a judgment or defending one.

High-Value Commercial & Consumer Asset Recovery

When a six- or seven-figure obligation goes unpaid, the issue extends beyond the balance. Cash flow disruptions, covenant pressures, partner concerns, and time-sensitive collection remedies all come into play.

For more than 35 years, our firm has represented creditors and defendants in significant financial disputes throughout Texas and in multi-state matters. Our experience includes more than 600 cases tried from both sides of the bench, providing a courtroom perspective that few firms can match. We understand how courts evaluate these claims because we have done so ourselves.

For creditors:
We focus exclusively on high-value recovery matters, including commercial portfolios, business accounts, and substantial consumer obligations over $100,000. This threshold is intentional. High-stakes recovery demands dedicated resources, proactive pre-judgment strategies, and the ability to pursue assets wherever they are located. Volume collection does not achieve these results.

Our creditor-side work includes:

* Commercial portfolio and business account recovery
* Judgment enforcement and post-judgment discovery
* Fraudulent transfer claims and asset tracing
* Pre-judgment remedies and injunctive relief
* Guaranty and personal-liability enforcement

For defendants:
A substantial collection action is not routine and should not be handled reactively. Disputed claims, contested balances, defective assignments, standing issues, and limitations defenses are all critical, but only if raised properly and on time. Without experienced counsel, organizations or individuals risk default judgments and long-term asset exposure.

Whether pursuing recovery or defending a substantial claim, the strategy established in the first 30 days often determines the outcome.

When a city labels your property a habitual criminal property, the clock is already running.

Habitual Criminal Property actions don't start in a courtroom. They start in an administrative review process built by the cities, run by the cities, and weighted toward the cities. By the time most commercial landlords and enterprise owners realize what's happening, the record has already been shaped against them.

That's why early intervention matters more here than almost anywhere else in municipal enforcement.

Gibson Herod is widely recognized as the premier choice for HCP counsel in North Texas.

Our approach:

∙ Intervene during the administrative phase, before the record hardens and leverage disappears.
∙ Apply deep regulatory familiarity with how Dallas and Fort Worth build and pursue these cases.
∙ Work directly with municipal authorities to negotiate compliance resolutions that keep properties operating.
∙ Maintain full trial readiness — including experience from both sides of the bench — for the cases where municipal overreach must be checked in court.

Most owners want a resolution. Cities often want the same. But you don't get a workable resolution by showing up unprepared to the administrative phase and hoping for goodwill. You get it by being the party that understands the process better than the enforcement team running it — and by being credibly ready to litigate if the process fails.

Commercial landlords, multi-site operators, and institutional owners across DFW rely on us for exactly that posture.

Facing an HCP notice or enforcement action? Talk to us before the next deadline.

We represent corporations, institutional partners, serial entrepreneurs, and private investors in high-stakes commercial disputes. Our courtroom strategies align with your financial and business objectives:

* Corporate asset protection

Our clients expect operational transparency, professionalism, and responsiveness. We provide proactive, clear communication throughout every stage of a dispute, not just after decisions are made.

When substantial financial interests are at stake, secure counsel that has seen litigation from the bench.

High-Value Commercial & Consumer Asset Recovery

Cash flow is the lifeline of any organization. When a major default threatens it, the response has to be strategic, not routine.

For more than 35 years, our business litigators have represented creditors with significant capital at stake — building recovery strategies designed for complex, contested disputes rather than volume collection work.

To ensure every client receives the dedicated resources and sophisticated advocacy these matters demand, our practice is focused exclusively on:

• Commercial portfolios
• Business accounts
• Substantial consumer debts exceeding $100,000

We also defend organizations and individuals facing high-stakes, disputed financial claims. Substantial collection actions require experienced institutional counsel — proceeding without it risks catastrophic default judgments and serious financial exposure.

Whether you are pursuing recovery or defending against a claim, the stakes justify experienced representation.
