Does cheating affect who gets what in a Texas divorce? Here is what you need to know 💔
As a divorce attorney and former Texas State Representative who chaired the House committee over family law, here is the truth.
A lot of people assume cheating does not matter. In Texas, it can.
✅ Texas allows both no fault and fault based divorce. Adultery is one of the recognized fault grounds.
✅ When a court divides community property in a just and right way, it can consider fault in the breakup, including adultery. That means the faithful spouse may be awarded a larger share in some cases.
✅ Spending marital money on an affair, think gifts, trips, or hotels, can be treated as wasting community assets, and a court can account for that in the division.
✅ Proof matters. Suspicion is not enough. Evidence is what makes the difference, and how and when it is presented is strategic.
✅ Cheating does not automatically decide custody, but behavior that affects the children can be relevant.
Every situation is different, and whether raising fault helps your case depends on the facts. That is where strategy comes in.
