In October, the Dallas Court of Appeals issued a “writ of injunction” prohibiting the City of Dallas from removing a 65-foot-tall Confederate Monument until an appeal of the underlying trial court decision (which was in the City’s favor) is decided. Yesterday evening, the City filed an emergency motion to reconsider, arguing (1) that a protest is planned for this Saturday at the monument; (2) that Confederate monuments have recently been damaged in recent protests in other parts of the country; and (3) that, if the 65-foot-tall monument were topped during the protest, anyone nearby could be seriously injured. I discussed the case (and the City’s mandamus currently pending in the Texas Supreme Court) on last night’s 10:00 news.
