Criminal negligence charges and a Texas Board of Nursing review can move at the same time. The Board's review is a separate proceeding with its own standards, so it does not have to wait for the criminal case to finish.

Not every nursing mistake rises to the level of criminal negligence.

Under Texas Penal Code 6.03(d), criminal negligence involves failing to perceive a substantial and unjustifiable risk when that failure represents a gross deviation from ordinary care.

An ordinary mistake may be something a careful and competent person could still make under pressure. Whether conduct crosses the line into criminal negligence depends on the specific facts involved.

Criminal negligence charges against a Texas nurse usually fall under one of two statutes. Both are state jail felonies at the negligence level, and which one applies depends on the facts.

When a Texas nurse faces criminal negligence charges after a patient incident, there may be more than one case to deal with.

A criminal case can move forward while the Texas Board of Nursing conducts its own review of the same event. The Board process can affect your nursing license regardless of how the criminal case ultimately ends.

A patient harm event alone does not automatically mean a crime occurred. Criminal negligence requires the State to prove conduct that meets the legal standard under Texas law.

Criminal negligence charges can create serious legal and professional consequences for a Texas nurse.

Texas Penal Code 6.03(d) defines criminal negligence as failing to perceive a substantial and unjustifiable risk when that failure represents a gross deviation from ordinary care. That standard is different from an ordinary mistake, and a patient harm event by itself does not automatically establish a crime.

Depending on the circumstances, criminally negligent homicide or injury to a child, elderly individual, or disabled individual may be investigated. At the same time, the Texas Board of Nursing can conduct its own review of the underlying incident.

Because statements made during one investigation may affect another proceeding, nurses facing questions about a patient incident should understand both processes before responding.
