Dismissal Day!

My client had drinks at a bar and thought the responsible thing to do was nap in his car rather than drive home and put others in danger IF he was intoxicated.

Bedford PD thought he should have a free night in jail and arrest him for Public Intoxication. Prosecutor told me that officer let him off with PI instead of arresting him for DWI because he was in a running car (which is operation of a vehicle in Texas). Hello Officer, we don’t sit in non-running cars with the windows up in Texas🤦🏾‍♀️

LAW TIP: Public intoxication requires you to be intoxicated in a public place and a danger to yourself or others.

My client was responsible. They parked their car. Officer even patrolled parking lot taking multiple passes before he approached my clients vehicle. There was no threat my client would drive.

State finally did the right thing and dismissed his case!!!

I know it’s only a Class C but this citation can still cause you to get arrested. My office is an avid supporter of YOUR RIGHTS no matter the level of punishment.

The US and Texas Constitution guarantee you a right to a fair jury trial with a panel that accurately reflects the population of the county.

To my North Texas Followers: While the elections may be over, its still a great time to get your Driver's License.

To all those who drive with a Texas ID and think it is the same as a driver's license, it is NOT.

DPS is open. Make an appointment. Take the tests. Get your license. Do NOT make lack of an actual driver's license the reason that an officer can arrest you and search your vehicle.

There are NO lines in Waxahachie and Waco DPS offices, so go to the website. Collect your necessary paperwork and documents, then take a small roadtrip to walk-in and walk-out of the DPS office with a brand new Texas DL.
