“My job doesn’t have workers’ comp.” Good news — that’s often better for you.

Texas is the only state where employers can opt out of workers’ comp. A lot of them do, including some very large companies. If that’s your employer, you don’t file a claim. You file a lawsuit.

That sounds worse. It usually isn’t. In the workers’ comp system there is no way to recover all of your damages. You get what the law says you get, regardless of how much you lost. Being able to file a lawsuit gives you a chance to recover ALL of your losses.

These lawsuits are called non-subscriber cases, and plaintiff’s lawyers actively look for them.

Hurt on the job and told there’s no comp? Call us before you assume you’re out of options — link in bio.

Most people don’t know this: in Texas, a business that keeps serving someone who’s clearly had too much to drink can be held responsible, even when the person hurt is the one they overserved.

In this wrongful death case, Michael Grossman recovered $2,050,000 for a family who lost someone they loved.

If over service at a bar or restaurant took someone from your family, you don’t have to figure out what comes next on your own. Send us a message or call Grossman Law Offices. We’ll listen, and we’ll tell you honestly where you stand.

On this 25th anniversary of September 11, the Grossman Law Offices family pauses to remember the victims, their families, and the firefighters, police officers, and first responders who gave everything.

Their courage reminds us what it means to show up for one another.

Nobody thinks about their totaled car after a wreck. You’re at the doctor, you’re fighting with an adjuster, you’re figuring out how to get to work. The car is the last thing on your mind.

Meanwhile it’s sitting in a lot somewhere on a clock nobody told you about. Tow yards don’t hold vehicles forever. Insurance companies move fast on salvage. And every car built in the last twenty years is quietly recording what happened in the seconds before impact.

Most people find that out after the car is gone.

You can prove they broke every rule. You can prove millions in damages. And you can still walk away with nothing.

A personal injury case is a tripod. Liability. Damages. And a defendant who can actually pay. Take away any one leg and the whole thing falls over.

The first two are the law. The third one is just common sense — and it’s the one people never see coming. A jury can award you eleventy trillion dollars, but if the guy who hit you has no job, no insurance, and nothing but the clothes on his back, that verdict is a piece of paper.

If you or someone you know got hurt and you’re not sure whether you actually have a case, give us a call. We’ll tell you straight — no charge to find out.

We could write a separate law for every careless act. Don’t throw rocks. Don’t rear-end people. Don’t wave someone into traffic.

Or we could just have negligence.

Duty. Breach. Causation. Damages. Preponderance of the evidence — meaning you only have to be a little more convincing than the other side.

One framework, infinite fact patterns. That’s the whole job.

This is one of the four elements we break down in the series. Follow for the rest and if you’re sitting on a case that fits, our number’s in the bio.

Say two street racers kill an innocent driver. The prosecutor charges murder one — and the jury lets him walk.

Not because they don’t care. Because every charge has elements, and you have to prove all of them. Murder one needs intent and premeditation. Street racing proves neither. Manslaughter would’ve stuck.

Injury cases work the same way. Negligence needs four: duty, breach, causation, damages. Miss one, no case.

Not sure if yours has all four? We’re happy to walk through it.

Murder and manslaughter aren’t the same crime — even though they both end with someone dead.

The difference comes down to a few key details: was it intentional? Was it planned?
That’s what lawyers call “case elements” — the specific list of things that have to be proven for a charge (or a lawsuit) to actually stick.

It works the same way in a negligence case. Before you can win, you have to prove the right elements — not just that something bad happened.

Think your situation checks those boxes? Message us — let’s find out.

4 out of 15 people blamed the motorcyclist for not wearing a helmet. The other 11 didn’t think it mattered at all.

Same case. Same evidence. Completely different conclusions and none of them were wrong.

That’s what “reasonable” means in the eyes of the law. No formula. No rulebook. Just normal people deciding what fairness looks like.

Don’t love how a jury might see it? That’s what jury duty is for.
