October is Domestic Violence Awareness Month, a time to raise awareness about an issue that impacts countless individuals and families, often behind closed doors.

Domestic violence goes beyond physical abuse. It can take many forms, including emotional manipulation, intimidation, isolation, financial control, and coercion. Each can have lasting effects on a person's safety, independence, and well-being.

In family law, these situations can make already difficult decisions surrounding divorce, child custody, and financial stability even more challenging.

No one should have to navigate these circumstances alone.

Access to experienced legal guidance, protective resources, and a strong support system can make a meaningful difference.

This October, we stand with survivors and recognize the advocates, legal professionals, and organizations working every day to help individuals reclaim their safety, independence, and future.

Awareness matters. Support matters. And everyone deserves to feel safe.

How to Craft Divorce Settlements Around Volatile Tech Stock.

A divorce requires careful consideration when dividing marital assets. When a significant portion of those assets includes tech stock, the process becomes even more complex. The inherent volatility of the tech sector presents unique challenges that need to be addressed with precision and foresight.

The Challenge of a Fluctuating Asset.

Unlike a savings account or a family home, which have relatively stable values, tech stocks can see dramatic price swings in short periods. A stock worth $1 million today could be worth half that—or double—by the time your divorce is finalized.

This volatility creates a significant problem. If you agree to a settlement based on a stock's value on a specific day, you are essentially gambling on its future performance. For instance, imagine a couple has $2 million in total assets, with $1 million held in tech stock. One spouse agrees to take the stock portfolio, and the other takes the remaining $1 million in other assets, such as cash and real estate. If the stock's value plummets a month later, then the spouse who took the shares is left with a drastically smaller settlement than intended. This is not a fair or equitable outcome.

Your children may not remember the divorce. They will remember the tension at the dinner table.

After years of practicing family law in California, I've seen a pattern: kids are rarely shaped by the day a marriage ends. They're shaped by the atmosphere around it, the silence, the sharp tones, the feeling that home is a place where everyone is on edge.

That doesn't mean divorce is always the answer. It does mean the question worth asking isn't only "Should we stay or go?" but also "What is our home feeling like right now, and what will it feel like a year from now?"

Whatever you decide, children do best with parents who are calm, consistent, and present. A well-structured parenting plan, a respectful co-parenting relationship, and a process that keeps conflict away from the kids all matter more than most people realize.

If you're weighing your options, start by getting informed. Understanding your rights and the process often takes away the fear that keeps families stuck.

Keeping the house is rarely about the house.

It's about stability. Familiarity. One less loss on top of everything else. That's a good reason to fight for it, as long as you know what it really takes.

Three things have to happen. Most agreements only get one or two right.

For most couples, the home is the biggest shared asset, and the most emotionally tangled. Wanting to stay for the kids' school, the stability, or one less loss right now makes complete sense. It's a valid reason to fight for it, as long as you know what "keeping it" actually requires.

Three things have to happen, and your agreement has to spell out all three:
1️⃣ Buy your spouse out of their share of the equity.
2️⃣ Get their name off the mortgage, not just the deed.
3️⃣ Pin the numbers and the deadlines down in writing.

Who Gets the Bitcoin in a Divorce?

Bitcoin and other cryptocurrencies can become an issue in a California divorce. If you or your spouse bought, sold, traded, mined, or held crypto during the marriage, the court may need to determine whether it is community property, separate property, or a mix of both.

The short answer is this: Bitcoin is treated like any other asset in a California divorce. It is not excluded from division just because it is digital, volatile, or stored in a wallet instead of a bank account.

The harder question is whether the Bitcoin belongs to one spouse alone or to both spouses together. That depends on when it was acquired, how it was paid for, and whether it can be properly traced.

If Bitcoin was purchased during the marriage using income earned during the marriage, it will usually be considered community property. It does not matter whose name is on the exchange account or who made the actual purchase. If community funds were used, both spouses may have an ownership interest.

Hiding assets during a California divorce is a serious legal violation. Courts can award up to 100% of a concealed asset's value to the innocent spouse under California Family Code Section 1101(g), and the offending party may face monetary sanctions, payment of the other spouse's attorney's fees, and, in egregious cases, criminal charges for perjury or fraud.

You are going through a divorce. The last thing you want is to discover that your spouse has been concealing bank accounts, transferring property to relatives, or underreporting income to gain an unfair advantage in the settlement. This situation happens more often than most people expect, and California law takes it seriously.

California is a community property state. That means all assets and debts acquired during the marriage generally belong equally to both spouses, and both parties are legally required to disclose their complete financial picture before any settlement is reached. When a spouse deliberately hides assets, they are not only violating that principle of equal division. They are committing a breach of fiduciary duty, potentially committing perjury, and exposing themselves to consequences that can far exceed whatever financial advantage they were trying to gain.

We can explain what the law requires, what hiding assets actually looks like in practice, and what penalties a California court can impose on a spouse who is caught.

Are Stock Options Considered Marital Property?

Stock options can be one of the more complicated assets to address in a divorce. They may have real value, but that value is not always easy to determine. Some options are already vested and can be exercised.

Others may not vest for months or years. Some could have been granted as a reward for work already performed, while others were meant to encourage future service with an employer.

So, are stock options considered marital property?

The honest answer is: often, yes, but it depends on the facts and the law in your state.

The Timing of the Grant Matters.

One of the first questions in any divorce involving stock options is when the options were granted.

If the options were granted during the marriage, they may be considered marital property, in whole or at least in part. This is especially true if they were earned through work performed while the spouses were married.

If the options were granted before the marriage, they may be separate property; that is not always the end of the analysis. If some of the options vested during the marriage, increased in value during the marriage, or were tied to work performed during the marriage, your spouse may claim that part of the value is marital.

If the options were granted after separation or after the divorce case began, the issue becomes more fact-specific. A court may look at whether the grant was compensation for work done during the marriage or intended as an incentive for future work.

That distinction can make a significant difference.
