Attorney Cross's trial for today was continued until a later date. While our office is disappointed with the continuance and strongly objected to the same, at this point, we must also respect the decision.

Our attorneys are gearing up for potentially a very busy September and October with jury trials, and we look forward to the challenges on the road ahead.

NOT GUILTY!

Attorney Cross wants to thank the Jurors, who served in the New Philadelphia Municipal Court today, for their service.

After around 30 minutes of deliberations, a verdict of Not Guilty was returned in favor of Attorney Cross's client who was charged with Domestic Violence.

Onto the next jury trial.... tomorrow morning ⚖️

Attorney Cross wants to thank the jurors who sat through the last two days of trial in the Coshocton County Court of Common Pleas.

This case had many late moving pieces, including a half-day Daubert Hearing Wednesday to address the scope of expert testimony/opinion. Then, trial commenced Thursday, and went into Friday afternoon.

While coming in second place is never desirable, the jury was highly attentive and easy to work with during the entire process from Voir dire through deliberations. Sometimes, you can't ask for much more.

Onto the next Jury Trial, Tuesday morning. ⚖️

We wanted to share some recent highlights of outcomes for clients of Attorney Cross:

1. A lifetime license suspension imposed in 2009 for a felony OVI conviction was suspended indefinitely. In Ohio, a license suspension for an OVI offense cannot technically be terminated. However, the suspension can be "suspended", which removes the suspension's enforcement, but makes it available to be imposed at a later date in the event a Court finds it to be appropriate.

2. A court issued a decision granting a Motion to Suppress, finding (1) No reasonable suspicion to detain and administer field sobriety tests, (2) a lack of substantial compliance with NHTSA's guidelines on the administration of the HGN test, and (3) no probable cause to arrest. As the State's appeal timeframe has now lapsed, this will result in a 3rd offense OVI being dismissed and denial of a vehicle forfeiture request.

3. In 2001, a lifetime license suspension was imposed on a client for aggravated vehicular homicide with substantial mitigating factors. A Motion to Terminate the lifetime suspension was filed, noting, among other things, compliance with all laws since 2001 and compliance with limited driving privileges for the last 12 years. The Court in that matter found that good cause existed for terminating the lifetime license suspension.

Our offices will be closed on Friday, July 24, 2026 except for any previously scheduled consultations. We will have a portion of our staff working remotely for phone calls and to keep the wheels of justice turning.

Like most courthouses that we routinely practice in, along with many governmental offices, we will be closed on Friday, July 3, as it is the "observed" Independence Day.

We will reopen on Monday at 8:30AM.

Keep in mind that the Judge will also not be back til Monday, so an arrest on Thursday evening could result in an extended stay at the Crow Bar Motel.
