Before buying a franchise in Florida, do not try to read the FDD from beginning to end.

Go directly to the pressure points:

Item 3: Litigation history
Item 7: Estimated initial investment
Item 19: Financial-performance representations
Item 20: Openings, closures and terminations
The state addenda and personal guarantee

Item 19 deserves particular attention. If a sales representative gives you revenue or earnings figures that do not appear in the FDD, that should raise questions.

You should also check whether the agreement requires disputes to be handled in another state and whether you are personally guaranteeing the franchise’s obligations.

Your Miami condo may be in Florida—but that does not automatically make it protected.

A creditor with a valid judgment from another state may be able to enforce it in Florida and pursue property located here. If the condo is a vacation home, pied-à-terre, or investment property, Florida’s homestead protection may not apply.

And simply placing the condo in a single-member LLC may not solve the problem.
