Depending on how the settlement is worded, some parts of a personal injury payment may be taxable.

The taxpayer failed to report any of the $700,000 payment as taxable income on his return. So the IRS stepped in and the case ended up in the Tax Court.

Reminder to all businesses to file and pay for your business tax receipts. They are due at the end of September for both cities and counties. Your failure to file and pay by the end of this month will cause financial penalties to be assessed. If you are in a city you should have one for the city and another for the county.

Remember to file your annual report with the Florida Secretary of State on or before May 1st. If you need assistance, please let me know. A $400 non-negotiable late fee will be imposed on any profit corporation, limited liability company, limited partnership and limited liability limited partnership annual report filed after midnight Eastern Standard Time on May 1st.

Beware of Florida Single Member LLC’s
Florida Single Member LLC’s offer minimal asset protection from creditors of a member. Multi-member LLC’s, if properly structured with a robust operating agreement, will generally provide excellent protection from such creditors. Possible actions a client can take are: convert a single member LLC into a multi member LLC or the client can convert the single member LLC to a Small Business Corporation.
It is important to note that single member LLC’s do not offer the same extent of protection as a corporation. If you have any questions regarding lack of protection, please contact our office to speak with an experienced attorney.

When filing please make sure the information is current and accurate. Many business will forget to confirm information and just renew as is. Many others forget to renew. As 2019 comes to a close I want to wish everyone a great holiday season. I also want all employers to know that 2020 will bring a change to Florida's minimum wage. Effective January 1, 2020, the minimum wage in Florida will be $8.56 per hour. If you have questions or you are not being paid correctly, feel free to give me a call.
