A lot of parents put off writing a will because the guardian decision feels too big to make. But if something happens to both parents and no guardian is named, a judge who has never met your children decides who raises them, and that process can take months. Custody orders written years ago often describe a summer schedule and a school year schedule as if the switch between them happens automatically. As kids head into a new grade with new after school activities, a new bus schedule, or a new school entirely, the order you signed may not say who decides on extracurriculars or which parent handles pickup on early release days. Those gaps tend to surface in September, not August, but they are far easier to sort out now while both parents can look at a calendar together instead of arguing over a text message. A house fire, a burst pipe, or a break-in can put you out of your home with no notice at all, and most people only discover where their important papers are when they go looking for them in a hurry. If your will, healthcare directive, and power of attorney exist only as one paper copy in a filing cabinet, they are gone the moment that cabinet is. Ask your attorney for a set of digital copies and store them somewhere you can pull up from your phone, and let at least one trusted person know where the originals live. August often means one last trip before school starts, and for a lot of families that means leaving the kids with grandparents for a few days. If something happens while you are away, a grandparent showing up at urgent care with a feverish eight year old may not be allowed to authorize treatment. A short document called a temporary guardianship authorization, sometimes called a caregiver's authorization affidavit, can give a grandparent or trusted relative the legal footing to make medical and school decisions while you are gone. July is one of the busiest months for moving, and a new job or a fresh start in another city can be exciting. If you share custody, though, moving any real distance with your children is rarely something you can decide on your own. Most custody orders and state laws require notice to the other parent and, in many cases, the court's permission before a child can be relocated. Moving first and asking later can put your whole custody arrangement at serious risk, no matter how good your reasons are. The parenting plan or child support order you signed a few years ago was based on the life you had then. If you have changed jobs, taken a pay cut or a raise, moved, or had another child since, the numbers and the schedule in that order may no longer match your reality. A lot of parents quietly operate on a handshake instead, paying a different amount or following a different schedule than the paper says. Photos, email, social media, online banking, and the loyalty points you have spent years building all sit in accounts your family may not be able to reach if something happens to you. Summer often means more time with extended family, and sometimes that time is when you first notice a parent slowing down. If your mother or father does not have a financial power of attorney or a healthcare power of attorney in place, you could find yourself locked out of helping them at the exact moment they need it most. Without those documents, families are frequently pushed into a court guardianship process that is slow, public, and costly, all to gain authority that a few signatures could have granted in advance. Starting that conversation is hard, but having it while your parents are still well is a gift to everyone at the table. If your child just turned 18 and is heading off to college this fall, the law now treats them as an adult. You no longer have automatic access to their medical records or the authority to make decisions for them in an emergency, even if they are still on your insurance and living at home for most of the year. A few documents can change that: a healthcare power of attorney and a financial power of attorney.
