As with everything else in co-parenting, parents should communicate with each other openly, if possible. Vacation co-parenting time is just another piece to the collaborative parenting puzzle that may need to be addressed in the shared parenting plan. For example, say your trip plans spill over into your ex’s parenting time. Is this a problem?

Unless your specific shared parenting plan says otherwise, in Ohio both parents are entitled to take at least one vacation during the year with your children. Give your ex as much notice as possible. Let them know your plans will likely interfere with some of their designated parenting time. Like with any trip, you should provide an itinerary to your ex to let them know where the children will be, what sort of activities they will be doing, and who they will be with, including emergency contact information.

According to the IOSR Journal of Humanities and Social Science, 81 percent of the nation’s top divorce lawyers claim clients have used social media as damning evidence against their spouses during the divorce process. Generally, all forms of social media (Facebook, Twitter, LinkedIn, Instagram, Snapchat, Myspace, etc.) are admissible as evidence in Court. Regardless of how slighted you feel, taking to a public forum to vent and share information comes with strong caution. As a general rule of divorce (as well as other family law court proceedings), whether on social media or otherwise, erring on the side of good taste and discretion is always the best practice. After a parenting time order is in place, even if the parents mutually agree to modify the schedule, nothing is binding unless it is incorporated into a subsequent court order. Therefore, it is important to confirm any change in parenting time, especially if significant, with the court.

In cases where the parents are not in agreement on a modification of parenting time, the parent seeking the change must file a Motion to Modify with the court. A Motion to Modify re-opens the case and allows the court to consider the current circumstances of the parents and children to determine if a change is warranted. When making such a determination, the court must again consider the best interest factors outlined in Ohio Revised Code Section 3109.04(F)(1).

If your spouse or co-parent is actively violating your decree/court orders, it is important that you document each incident. Documentation and record-keeping are key to prevailing in a court action. Keep records of communication between you and your former spouse or co-parent regarding requests for payment, parenting time, or otherwise. Even if you believe your requests will go unanswered, it is important to continue requesting the other person’s compliance, as this will demonstrate to the Ohio court your efforts and cooperation.
