The EEOC investigates retaliation.
But it’s usually not the type of retaliation people think of.

It only investigates retaliation related to your complaint of discrimination based on your protected class.

Here are some of the different reasons you may want to file in federal court vs state court:

1) discrimination laws may not exist on state level

This could be because your state doesn’t have any state laws OR the type of claim doesn’t exist (like 1981 action)

2) can bring federal AND state law claims in federal court

If you bring in state court, you give up your federal claims though

3) better discovery rules

Federal court has the discovery rules laid out pretty strictly. Your state may not, which could mean your company makes you go through more discovery games.

What happens after you get an EEOC position statement? And what can you do?

Well, what you decide to do impacts what happens next!

There’s a couple different options:

1) Submit a rebuttal
- this is your response

2) Don’t do anything
- this will likely lead back to continuing the investigation

3) Request the right to sue
- DO NOT do this unless you are ready to file that day.

Favoritism is probably one of the most common complaints that people have at work. But is it illegal?

Usually favoritism is not going to be illegal.

But, if the favoritism is based on your protective class, then it could be illegal discrimination.

And if you’re employed by a state or local government, sometimes there are some laws related to favoritism or nepotism that could apply to your situation too.

BUT

Generally, it’s better to file with an attorney.

But there are two scenarios where you should file without one.

1) if you’re running short on time

The EEOC will not give you extra time to file, even if you’re looking for an attorney.

2) if you can’t find an attorney.

Sometimes the reason you can’t find an attorney has nothing to do with you.

The attorney could be busy.

Or you could even be talking to the wrong attorney.

But if you file, you can still get representation later.
