We believe because the prison authorities and legislators will not act, local prosecutors should. Much like a conviction integrity unit, there are sentening units who review the current perspecitve on an old sentencing. Was a judge too harsh 20 yers ago? Has the person significantly changed their life in prison where it warrants a review of the appropriateness of that sentence in light of new information? We recently argued the inappropriat use of a client's music has no reflection his propensity for violence in the court of appeals. While there was a bit of recognition for the concept they let the conviction stand despite a prosecutor beging permitted to ask the client on the stand if he agreed with the lyrics?

Our good friend Jay Clark was asked to help out death row inmate a few years ago by helping to file some papers locally. Just like Jay he said yes. Now three years later and with hundreds of hours donated by him in working with David Hine and Emily St Cyr from Vorys, Sater, Seymour and Pease LLP Elwood Jones is not only home with his family this Chritmas after they demonstrated he was innocent and the State of Ohio hid evidence, medical information, other suspects, exculpatory material and over 4000 pages of records, today he is no longer a defendant. Past prosecutors abandnoned their duty to seek justice in fighting to keep an innocent man on death row. Not Connie Pillich and her office. Today they dismissed the indictment forever. The sad note is the Nathan family was told by police and prosecutors Mr. Jones was the killer when they knew different. Mr. Jones spent 28 years on death row for a crime he did not commit. A real killer was never investigated and not never will be. Jay, David and Emily; you are lifesavers and heros to many. Congratulations

Wow!! Maybe the third time is a charm. If you cant convince 1/2 the jurors to find adequate evidence to warrant a trial twice now your chances at trial are pretty slim even if you do get past this very low hurdle in the prosecution process.

It was great getting the chance to argue against you yesterday. I googled you up the minute I saw who {client] hired and immediately garnered a lot of respect for you. You have achieved in your career what I hope to achieve in mine.

Yesterday was my last appellate argument as a prosecutor as I am opening my own defense practice in January. I am hoping our paths may cross again and I might have the ability to learn from you in the future. It is seriously impressive all that you have accomplished in your career.
