I have defended cases ranging from the most serious felonies, including capital murder (death penalty) and other homicides, serious s*x offenses, robberies, and kidnappings, to DUI cases, assault cases, and other misdemeanors and traffic cases. I have taken numerous felony and misdemeanor cases to trial. I have also served as Special Counsel for Hamilton County. I am certified in Standardized Field Sobriety Testing (the field tests for DUI), and I am also certified by the Ohio Supreme Court to represent defendants in death penalty cases. I have been active with the Cincinnati Bar Association (CBA) for much of my career. In 2008, I completed the Cincinnati Academy of Leadership for Lawyers (CALL) Program through the CBA in my first year of eligibility. I currently serve on three committees for the CBA. I am a member of the Professionalism Committee, the Vice Chair for the Health and Well-Being Committee, and I am the past Chair for the Lawyer Referral Service Board Advisory Committee. I have presented at CLEs through the CBA about professional conduct and wellness. I have written articles for the CBA Report on fitness and wellness, and I have also given presentations about fitness for attorneys. Outside of the CBA, I have been a regular guest for legal commentary and other topics on the Bill Cunningham show as well as on other shows on 700 WLW. I have presented at CLEs about false confessions, I have provided legal instruction in Ohio Concealed Carry Training classes, and I am a New Lawyer Mentor through the Ohio Supreme Court. Unrelated to any of my work, I was also the announcer for University of Cincinnati home swimming meets for three seasons. Prior to opening my law practice in October 2003, I was an associate for the law firm Delev & Williams. I graduated from the University of Cincinnati Law School in 2002, and I was admitted to the Ohio bar the same year. In 2003, I was admitted to practice in the United States District Court for the Southern District of Ohio. I attended the University of Cincinnati for my undergraduate work, during which time I earned multiple academic honors while I was a 4-year letterwinner for the varsity swim team.

On this date in 1941, baseball’s “Iron Horse,” Lou Gehrig, died at age 37 of the degenerative disease amyotrophic lateral sclerosis, also known as ALS or Lou Gehrig’s disease. Lou Gehrig Day is an annual MLB event to celebrate the life and legacy of Lou Gehrig and to raise awareness and funds for ALS.

WHY DO I POST DUI TIPS?

The problem with DUI enforcement is that you can be perfectly sober and still have an officer subjectively decide you're impaired. My favorite example is from an incident at court a few years ago. A courtroom bailiff (a former officer) held my client because he thought my client looked intoxicated and thought he smelled alcohol on my client's breath. The judge called in a probation officer to take a breath test from my client, and it showed his blood alcohol level was .000- and keep in mind the bailiff only suspected alcohol. The bailiff who thought he was making a collar had a very embarrassed look on his face, and I had a few harsh words for him for holding my client and wasting my time. This is just one example, but this kind of faulty subjectivity is more common than many people realize. I've also had clients get arrested after testing BELOW the legal limit, again based on the officer's subjective observations.

Additionally, I have the same training in field sobriety testing as officers. EVERY time I've administered these tests on sober people at places like business networking meetings, I've found enough mistakes to constitute probable cause to arrest. Hint: you don't pass those tests by just not falling over.

That's why I advise to politely refuse all tests and not answer any questions without speaking to a lawyer. ⚖️🤐
