GREAT JOB ATTORNEY J.R. BERNANS!

On June 3rd in the Clermont County Common Pleas Court General Division, Attorney J.R. Bernans successfully secured a full dismissal of a civil protection order prior to a full hearing.

A dispute arose between a daughter, her father and the father’s long-term girlfriend over control of her father’s assets and inheritance. The daughter sought control over her father and did not like her power of attorney being taken away.

The daughter sought a menacing by stalking civil protection under Ohio Revised Code 2903.214 claiming that her dad had suffered physical harm or mental distress at the hands of his girlfriend.

Despite the father asking for a dismissal at the ex parte hearing, the temporary protection order was granted and a full trial scheduled. Upon getting involved, J.R. immediately took a proactive approach – interviewing witnesses, finding exculpatory exhibits, and filing motions with the Court seeking a dismissal.

Prior to trial commencing, J.R. argued that the case be dismissed for improper venue, the court’s lack of jurisdiction, and a lack of standing on behalf of the petitioner. The Court agreed and threw out the case and reunited two people who were forcibly ripped apart.
