The question of birthright citizenship is interesting. Exactly what does "subject to the jurisdiction of the United States" mean? Who is not subject to the jurisdiction of the US if they're born here? We'll, before the 13th Amendment, slaves weren't subject to such jurisdiction. Congress claimed jurisdiction over children born to slaves and former slaves by passing th 13th Amendment. So, under the 14th Amendment, they have birthright citizenship. The Indian Citizenship Act of 1924 gave the US jurisdiction over Indians. So, who today is not subject to the jurisdiction of the U.S. if they're born here? Other than children of diplomats, I can't think of any other group.
