It only takes one missed medication order to change a family's life forever.

Michael Bonamarte talks about a recent case in which our client suffered a catastrophic stroke as a result of medication mismanagement. Our client had been on a blood thinner for 15 years. After surgery, doctors were clear: restart the medication, check his levels every day. Somewhere between the hospital and the nursing home, that instruction got lost. No one caught it. No one saw him in person to check on him. Days later, he was found unresponsive from a stroke that could have been prevented.

If you have a loved one in a nursing home or recovering from surgery, this is worth watching.

Margaret Battersby Black is pushing for change in Illinois, and making it happen.

Senate Bill 3398, signed by Governor Pritzker in August, closes a gap Margaret saw again and again in her practice. When a loved one is too sick, injured, or incapacitated to make their own medical decisions, a hospital can appoint a family member as a surrogate decision-maker, so care can move forward. But that same authority often didn't extend to requesting medical records, records families need to find out if a medical error caused the injury in the first place.

Margaret worked to change that. Now surrogate decision makers have the same authority to obtain those records for any purpose.

This is what advocacy looks like outside the courtroom: not just fighting for clients individually, but working to change the system for everyone who may end up in their position.

This week, a DuPage County jury returned a $2 million verdict in favor of our client against Elmhurst Memorial Hospital following a two-week trial.

Our client, a below-the-knee amputee, entered the hospital for elective hip replacement surgery with intact skin. Six days later, hospital staff identified a deep tissue pressure injury on his left buttock.

The case, tried by Gabriel Aprati and Nix Emerson of Levin and Perconti, alleged that Elmhurst nursing staff failed to provide appropriate turning, repositioning, and offloading; failed to timely provide a pressure-relieving support surface; and failed to develop and implement an appropriate plan of care despite daily assessments identifying our client as being at high risk for pressure injuries like this.

The wound remained open for more than three years, requiring more than 50 wound debridements and four surgical procedures.

The jury returned a guilty verdict in favor of our client and against Elmhurst Memorial Hospital.
