There are STILL so many news agencies and citizen reporters publicizing FALSE OR INACCURATE AND THUS MISLEADING INFORMATION about the matter of Gwendolyn Evette White and her mother Elleen White and the Defendant tortfeasors and cases for which she's been a party over the years.
I'm going to record a concise video fact checking and dispelling all the "noise."
I plan to post it today.
Most immediately, what needs to be cleared up is the notion that Gwendolyn was somehow deemed mentally incompetent by a Wake County court in 2024. THAT IS FALSE. Yahoo News has falsely or otherwise inaccurately reported in this regard. They misrepresent the averments (statements) by Gwendolyn's mother's (Elleen White) guardian ad litem ("g/a/1") which actually states:
"Gwen has a pending misdemeanor stalking charge (23-CR-418419-910) in which a CourtOrder was entered on May 3, 2024 finding Gwen was not capable of proceeding to trial and theCourt ordered Gwen to participate in the Community Based Restoration Program at ElwynHealth Resources for examination and treatment until further order of the Court with theobjective of assisting Gwen to gain capacity to proceed, if possible. When asked about theseproceedings, Gwen stated that her son had lied about her mental health and false information wasentered into her medical record which she was in the process of having removed. The g/a/ladvised Gwen that she likely could not qualify to serve as the Respondent's guardian with these pending criminal charges. Gwen stated that she would like her family friend, Pamela Medley, tobe considered as a potential guardian if one is appointed. The g/a/l spoke with Ms. Medley whoreported that she lives a couple hours away but may be willing to serve as a guardian if neededalthough she feels Gwen is best suited to make decisions regarding her mother's care."
There are SEVERAL PROBLEMS WITH THIS AVERMENT by the guardian ad litem, Cameron Stanton, who is a licensed attorney N.C. Bar No. 48281 (self-authenticated based on the signature and designation in the November 14, 2024 Guardian Ad Litem report AND I verified with the NC Bar which I included with the doc accessible below):
1. 50C No Contact (stalking) cases are indexed as CR or criminal cases but adjudicated generally as civil cases unless there is a violation of the order. These and DVPO cases are generally not publicly accessible in eCourts, but of course are accessible through the clerk of court (in this case Wake County)
2. I pulled all case records searching for "Gwendolyn White" irrespective of her actual middle name to ascertain which cases were "hers" and which were not (I'll be including that in my TikTok, and know there's a lot of these cases that ARE NOT "HERS" in that it's another person altogether with the same name , afterall her name is common)
3. If Gwendolyn had somehow violated the 50C No Contact order, now THAT CASE would be strictly criminal AND accesible in Odyssey (eCourts) but there is NO RECORD OF ANY CRIMINAL CASE CHARGING HER with violating a 50C order
4. The case to Cameron refers WAS PENDING AT THAT TIME, AND THERE HAD BEEN NO FINAL DECISION IN THAT 50C case SO IT WAS IMPROPER FOR CAMERON TO CITE IT AS A REASON TO "DISQUALIFY" GWENDOLYN FROM BEING GUARDIAN AD LITEM FOR HER MOTHER
AND IN THAT CAMERON IS A LICENSED ATTORNEY, SHE KNOWS BETTER THAN TO DO THAT (partially in Cameron's defense, the averment states "The g/a/ladvised Gwen that she LIKELY COULD NOT QUALIFY to serve as the Respondent's guardian with these pending criminal charges" as opposed to making a definitive declaration that an attorney can't make and instead a judge would have to make that decision, and which decision would be still be subject to appeal if Gwendolyn took such action.
5. I found absolutely no court order adopting the recommendation of a licensed psychologist finding Gwendolyn incompetent, so even Yahoo news' suggestion is LIBELOUS
