This month is Motorcycle Safety Month. In 1979, the universal helmet law in Indiana was repealed. Now, only motorcyclists under 18 years old are required to wear a helmet. However, we highly recommend that motorcyclists over 18 do so as well. Helmets not only protect you while riding, but also protect you in case of a crash.

After universal helmet laws were reinstated in Louisiana, fatalities in motorcycle crashes were reported to be 30% less likely. Helmets help reduce the risk of severe brain injuries by 70%, head injuries by 69%, and neck injuries by 50%.

For our fellow automobile drivers, pay attention while driving. Motorcycles are smaller and harder to see than other vehicles, but still have the same rights on the road. Stay safe while driving, whether it's a car, truck, or motorcycle, and have a happy May! 🌷

Happy April! This month is Distracted Driving Awareness Month. Using your phone while driving creates a huge risk for yourself and other drivers on the roads. Indiana law specifically states that drivers may not use or hold a telecommunications device unless calling 911 or using hands-free technology. If you need to use your phone, pull over safely or have a passenger send the message for you. Help keep our roads safe and don't text and drive.

Happy Friday! Last week I took Jamison to Bub's Burgers & Ice Cream for lunch and he decided to eat the Big Ugly on his FIRST time there. We've been at our office in Carmel for a couple months now, but I think this is what's made him a true Carmel guy 😂 For those who don't know, the Big Ugly is a massive burger (the last picture is his burger vs mine) and the challenge is to eat the entire thing in one sitting. If you do it, you get your picture up on the wall. Maybe when he's finally ready to eat a burger again in 6 months, he'll try for 2 of them. Have a good weekend everyone!

🍀Happy St. Patrick's Day from Loyalty Law! 🍀 Today we want to stress the importance of being safe on the roads, especially on big drinking holidays. The US Department of Transportation reports that almost half of drivers involved in fatal crashes in the early hours of the morning after St. Patty's day were drunk (2023). Please don't put yourself or others at risk of serious injury or death. Even if you ARE being a safe and sober driver, you still need to be careful. Look both ways at intersections and stay away from vehicles driving erratically.

Here's a message from Jamison on how you can celebrate and have fun while also being safe:

(1) Celebrate at home.
(2) If you want to go out and drink, have a designated driver or call a rideshare company. Yes, rides will be expensive tonight due to demand. However, the cost is cheap when compared to medical bills, car repairs, and retainers for criminal defense attorneys.
(3) If you need to drive but still want to enjoy alcohol, make smart decisions and stick with them. Before you go out, decide the number of drinks you will have and the time when you are going to stop. Leave some wiggle room so that even if the drinks are stronger than normal, you will not be intoxicated when you get behind the wheel.
(4) Don’t be an awful friend and encourage someone else to drink more than they want.
(5) Don’t get into arguments while drinking. Arguments add the effects of emotion to the effects of alcohol. If you want to argue, call me. I’m a trial lawyer. I’ll argue with anyone about anything!

Hello, my friends. Jamison here. I am sincerely thankful for all the congratulations for launching the firm and being selected by Super Lawyers. I am posting today to ask everyone a favor and make sure Taylor is properly recognized. While there is no equivalent organization that identifies outstanding staff, I assure you no lawyer can be super without the right staff. Although Taylor’s name is not on the award, she does so many of the things necessary for a trial lawyer’s success. I could never replace her sincere drive to help people and her motivation to correct anything that is unfair. Today, we want to emphasize the importance of wearing a helmet when biking, riding a motorcycle, skiing, and doing other activities. According to the Brain Injury Association of America, helmets can reduce the likelihood of brain injuries by up to 88%. They reduce the risk of severe brain injuries by 75%.

Yesterday, Attorney Jamison Allen presented an oral argument before the Indiana Court of Appeals in a premises liability case that left our client with a severely broken ankle.

A central issue on appeal concerns missing security footage. The apartment complex had a camera covering the area, knew of the injury two days later, promptly prepared a report, but then failed to save any video whatsoever. Jamison fought at trial to give a “spoliation” instruction to the jury, saying the jury may infer the deleted video’s content would have been unfavorable to the apartment complex. The trial court refused to give the jury instruction and provided no explanation for its refusal. The jury then returned a verdict in favor of the apartment complex.

Appellate court opinions become precedent that must be followed by every trial court in Indiana in future cases. Therefore, appellate judges understandably question both parties aggressively to ensure they make the correct decision. An opportunity to influence Indiana law in such a broad manner often never arises in an attorney’s career. Jamison was proud to be the attorney leading the battle to fully instruct juries and preserve the evidence necessary to know the truth.

On Saturday, Loyalty Injury Law had the honor of attending Franklin’s Historic Artcraft Theatre’s annual sponsorship party! We contributed over $5,000 to be the cartoon sponsor in May and December and the concession sponsor in August. We saw familiar faces, met new friends, and even got to do a little swing dancing.
