A recent U.S. Supreme Court decision will likely affect how courts analyze freight broker liability in trucking cases. In a unanimous ruling in Montgomery v. Caribe Transport II, the Court held that federal law does not broadly preempt state-law negligent hiring claims against freight brokers. The decision creates a clearer pathway for injured plaintiffs to pursue accountability following serious truck accidents.

🚨 Case Update in Ethylene Oxide Litigation Against Sterigenics

The case alleges that Defendants emitted Ethylene Oxide, a known human carcinogen, from their sterilization facilities, poisoning Maywood residents for decades and causing breast, stomach, and blood cancers.

Defendants filed several motions for summary judgment to prevent the cases from going to trial. Defendants’ Motions were denied, allowing the cases to proceed to trial as early as January 2027.

A federal judge has granted final approval of a $110 million Wells Fargo shareholder derivative settlement involving allegations that the bank failed to properly oversee discriminatory hiring and lending practices.

The settlement includes a $100 million Borrower Assistance Fund that will provide mortgage assistance to benefit low and moderate income borrowers in designated census tracts across more than 50 metropolitan areas nationwide, and an additional $10 million in cash.

“The public has the right to expect that Wells Fargo’s hiring and lending decisions will be based on legitimate factors. Today’s settlement launches a new program that will provide down payment and closing costs assistance to thousands of low and moderate-income borrowers and help them obtain the benefits of homeownership,” said CPM partner Mark Molumphy.

Mark Molumphy, Tyson Redenbarger, Gia Jung, and Elle Lewis worked on the case from Cotchett, Pitre & McCarthy, LLP, one of the Court-appointed Co-Lead Counsel.
