On August 6, our Summer Associates put their trial advocacy skills to the test during CPM’s Summer Associate Mock Trial at the Cotchett Advocacy Center Courtroom at UC Law San Francisco, taking on a products liability and wrongful death case.

A special thank you to the Hon. Susan Greenberg (Ret.) for graciously serving as judge, and to our college and high school interns who stepped in as witnesses.

CPM Partner Brian Danitz is featured in the Daily Journal following a federal court ruling in a case involving more than 100,000 Californians who allege Bank of America failed to protect their pandemic-era unemployment benefits from fraud.
Danitz serves as co-lead counsel for the class. The ruling allows claims for treble and punitive damages to proceed.

“The bank wouldn’t even talk to them — if they could even get through the phone lines,” Danitz said. “It was a complete turning away from this vulnerable population. And the bank has been fighting this for over five years, throwing everything they have at getting rid of the case. Finally, we can see our way to trial.”

CASE UPDATE: CPM has filed a proposed nationwide class action against computer peripheral manufacturer Logitech on behalf of consumers, alleging that Logitech raised prices on roughly half of its U.S. product catalog, including keyboards, mice, and headsets, to cover the cost of tariffs. After the Supreme Court declared those tariffs unlawful and required tariff payments to be refunded, Logitech has failed to return over $61 million of tariff refunds to consumers. This case is being handled by CPM attorneys Joe Cotchett, Sarvenaz “Nazy” J. Fahimi, Pierce H. Stanley, and Vasti S. Montiel.

“Logitech blamed tariffs when it raised prices. Then the Supreme Court struck those tariffs down. Logitech should return the tariff money to customers who footed the bill in the first place.”

Following Tuesday’s $33 million verdict, KRON4 News spoke with CPM partner and lead trial attorney Niall McCarthy about the case and the responsibility parents have to act when there are warning signs involving their teenage children.

“We are hopeful today’s verdict serves as a wakeup call to Bay Area parents,” McCarthy said. “You cannot ignore warning signs with your teenage children.”

Madison and Olivia Ammen were just 7 years old when they lost both of their parents in the 2022 Redwood City crash. The jury’s $33 million award recognizes the loss of their parents’ love, companionship, care, protection, affection, and support.

“Two young girls no longer have parents because of the Morales Family’s decisions,” McCarthy said.

The teen driver and his parents were found liable by the jury.
