Fraudulent Life Insurance Agents and Fraudulent Life Insurance Sales is rampant with very little oversight.
When an Insurance Sale Becomes Financial Exploitation
Life insurance and annuity products can serve legitimate financial purposes. But they can also be extremely complicated.
Problems may arise when an older customer is encouraged to:
* Move substantial retirement or investment assets into an insurance product;
* Replace an existing policy or annuity unnecessarily;
* Purchase a product that requires premiums the customer cannot reasonably afford;
* Buy an annuity or life insurance policy that does not fit the customer’s age, income, liquidity needs, or financial objectives;
* Surrender investments and incur substantial penalties or tax consequences;
* Purchase a product based on misleading statements about guarantees, safety, income, liquidity, or investment performance; or
* Rely upon a trusted financial professional whose recommendation is influenced by commissions rather than the customer’s best interests.
The fact that a product is technically an insurance product rather than a traditional security does not mean that the customer is without legal protection.
The Company Behind the Salesperson May Matter
One of the most important questions in these cases is often not simply what the individual salesperson did, but what the company knew, what it should have known, and what it did to supervise the transaction.
Financial institutions and insurance companies may have systems designed to review applications, replacements, premium levels, customer age, source of funds and other circumstances that can indicate an unsuitable or potentially abusive transaction.
When significant losses occur, the entire sales process should be examined — including the salesperson’s representations, compensation, application documents, suitability information, supervisory reviews, emails, account records and the source of the money used to purchase the product.
Older Investors and Their Families Should Ask Questions
If you or a family member was persuaded to purchase an annuity, life insurance policy, structured product or other investment that you did not fully understand, the transaction deserves careful review.
Warning signs can include unexpectedly large surrender charges, difficulty accessing money, premiums that consume a significant portion of income, promises that do not match the written contract, or discovering that the salesperson received substantial compensation from the transaction.
