Is your lawyer ghosting you? 👻

The #1 thing we hear from new clients who switched to us: “I couldn’t get my last lawyer on the phone.”

If your calls aren’t returned, you only ever talk to a case manager, or you have no idea what’s happening with your case, that’s a red flag, not normal.

In personal injury cases, silence isn’t a strategy. Evidence disappears, witnesses forget, and deadlines pass. We’ve seen people trust a lawyer to handle everything, only to learn later that a deadline was missed.

You’re allowed to expect more.

At Hoestenbach Law Group, you talk to your attorney, you get updates without chasing them, and you always know where your case stands.

Lawyer gone quiet? It might be time for a change. Free consultation, and yes, we call back. 📞 866-969-4040

Proximate Cause: The “Why” Behind Liability ⚖️

In a personal injury case, it’s not always enough to show that someone was careless and that an injury occurred. There also has to be a legally sufficient connection between the conduct and the harm. That concept is known as proximate cause.

Think about a car accident: A driver runs a red light and hits another vehicle. The connection between the driver's actions and the resulting injuries may appear straightforward. But what if something else happens in between? What if an unexpected event contributes to the injury? What if the harm was not a foreseeable result of the original conduct? That’s where proximate cause becomes critical.

Courts may examine questions such as:
➡️ Was the injury a reasonably foreseeable result of the conduct?
➡️ Was there an intervening event that changed the chain of events?
➡️ Is the connection between the conduct and injury legally close enough to support liability?

Proximate cause can be one of the most important, and most contested, issues in an injury case. It helps distinguish between an event that is simply connected to an injury and conduct that may be legally responsible for it.

As a recent National Law Review article on proximate cause explains, intervening events, foreseeability, and the specific facts of a case can all play a significant role in determining liability.

Because in personal injury law, the question isn't always just: “What happened?” Sometimes, the bigger question is: “What legally caused it?”

E-Bike popularity is growing… So Are the Safety Concerns 🚲⚠️

E-bikes have quickly become a popular way to commute, exercise, and get around—but as more riders hit the roads, e-bike-related injuries are increasing as well.

A recent article in The National Law Review highlights several causes of e-bike injuries, including:

🚗 Collisions with motor vehicles
🛞 Falls and roadway hazards
⚙️ Mechanical or equipment failures
🔋 Lithium-ion battery failures
🚲 Brake, steering, tire, or frame defects

The important takeaway? Not every e-bike injury is simply “rider error.” When someone is seriously injured, it's important to understand why the crash happened. In some cases, there may be questions involving a defective product, inadequate warnings, or a manufacturing or design problem. And if a serious injury occurs, preserve the e-bike, battery, charger, and any damaged components. Those items could become critical evidence. As e-bike use continues to grow, so should awareness about how to ride, and how to recognize when something beyond rider error may have caused an injury.
