Child Support Modification

Hi there! I just wanted to drop in to give you guys some information about modifying your child support order.

If you're ordered to pay child support but have found that you're not in a position to pay the full amount, do not just stop paying or reduce your payments. Even if you have a great relationship with the custodial parent and s/he agrees to accept less than the court ordered amount, do not do it without modifying it with the court. Until the court grants a modification of the original child support, you are still obligated to pay the original amount. Whatever you don't pay is still accruing and can be called due whenever the custodial parent decides to petition the court to find you in contempt for not paying the full amount. Your side agreement may not be honored, especially if the custodial parent denies ever having made one.

If you have experienced a change in income based on unemployment or under employment, change in family size, disability, etc., petition the court to modify your child support BEFORE you fall behind on payments.
