You Were Named Executor. Now What? πŸ“‹βœ…

Getting a call that you've been named Executor of someone's estate can feel overwhelming β€” especially while you're also grieving. But knowing what to do first can make all the difference.

Your first 5 steps as a Georgia Executor:
β€’ Step 1: Locate the original Will and any trust documents
β€’ Step 2: Obtain certified copies of the death certificate (you'll need several)
β€’ Step 3: File the Will with the Georgia Probate Court in the county where the deceased lived
β€’ Step 4: Obtain Letters Testamentary β€” the court document that gives you legal authority to act
β€’ Step 5: Open an estate bank account and begin notifying creditors and financial institutions

What comes next:
β€’ Taking inventory of all assets and debts
β€’ Paying valid creditor claims in the correct legal priority
β€’ Filing any required tax returns
β€’ Distributing assets to heirs according to the Will

Being an Executor is a legal responsibility β€” not just an honor. Mistakes can expose you to personal liability.

✨ You don't have to figure this out alone.
Duckett Law LLC guides Executors through every step of the Georgia probate process.

The Real Cost of Care in Georgia β€” Are You Prepared? πŸ’ΈπŸ₯

Long-term care is one of the largest unplanned expenses a Georgia family can face β€” and most people have no idea how quickly costs add up.

Average costs in Georgia (2024 data):
β€’ In-home care (home health aide): ~$29/hour
β€’ Adult Day Care: ~$100/day
β€’ Assisted Living: ~$4,940/month
β€’ Nursing Home (semi-private room): ~$8,820/month
β€’ Nursing Home (private room): ~$9,430/month
πŸ“Š Source: Genworth & CareScout 2024 Cost of Care Survey

Medicare covers very limited long-term care. Most families are surprised to learn that without Medicaid planning or long-term care insurance, these costs come entirely out of pocket.

The earlier you plan, the more options you have β€” including:
β€’ Medicaid asset protection strategies
β€’ Irrevocable trusts for home and asset preservation
β€’ Caregiver agreements that comply with Medicaid rules

At Duckett Law LLC, we help Georgia families plan for these realities before a crisis forces their hand.

✨ Hope for the best, but plan for the real costs.
Your family's financial security depends on it.

How to Start the Estate Planning Conversation With Your Aging Parents πŸ’¬β€οΈ

You know it needs to happen. But every time you think about bringing it up, it feels too heavy, too awkward, or too soon. The truth is β€” there's no perfect moment. But there is a better way to approach it.

5 tips for starting "the talk":
β€’ Choose a calm, private moment β€” not during a holiday or a health crisis
β€’ Lead with love, not logistics: "I want to make sure you're taken care of"
β€’ Ask questions instead of making statements: "Have you ever thought about what you'd want if something happened?"
β€’ Normalize the conversation: share that you're working on your own estate plan too
β€’ Focus on their wishes β€” not the paperwork

What to cover when the time is right:
β€’ Do they have a Will, POA, and Healthcare Directive?
β€’ Where are their important documents stored?
β€’ Who do they want making decisions if they can't?

✨ The hardest part is starting. After that, most families feel relieved β€” not stressed.
Give your family the gift of clarity.

Georgia's Year's Support β€” A Powerful Probate Protection Most Families Don't Know About πŸ›‘οΈπŸ‘

Did you know Georgia law gives surviving spouses and minor children a powerful financial tool that can work even when there's a Will β€” or no Will at all? It's called Year's Support, and it could be the most important Georgia-specific protection your family has never heard of.

Here's how it works:
β€’ A surviving spouse or minor child can petition the Georgia Probate Court for a Year's Support award
β€’ The court can set aside property β€” including real estate and financial assets β€” for their support
β€’ Year's Support takes priority over most creditors and estate debts
β€’ It can be used even if the deceased had significant debts or a complicated estate

Year's Support is a uniquely Georgia remedy β€” and it has a filing deadline. Waiting too long after a loved one's passing can forfeit this right entirely.

At Duckett Law LLC, we make sure grieving families know every option available to protect their financial security.

✨ Georgia law has built-in protections for your family β€” but you have to act.
Don't leave money or property on the table.

Conservatorship vs. Power of Attorney β€” Know the Difference Before It's Too Late πŸ§“βš–οΈ

Two of the most misunderstood tools in elder law are Conservatorship and Power of Attorney. They serve similar purposes β€” giving someone authority to act on another's behalf β€” but they are very different in how they work, when they apply, and what they cost.

Power of Attorney (POA):
β€’ Chosen voluntarily while the person has mental capacity
β€’ Takes effect immediately or upon incapacity, depending on the document
β€’ Faster, less expensive, and more private
β€’ Can cover finances, healthcare decisions, or both

Conservatorship:
β€’ Ordered by a Georgia court when a person is already incapacitated
β€’ Removes legal rights from the individual
β€’ Requires ongoing court oversight and reporting
β€’ More costly and time-consuming for families

The critical difference? A POA is planned. Conservatorship is reactive.

At Duckett Law LLC, we help clients put the right documents in place while they still have a choice.

✨ Don't wait for a judge to decide who speaks for you.
Plan ahead with a Power of Attorney.

Died Without a Will in Georgia? Here's What Happens βš–οΈπŸ

If you pass away without a valid Will in Georgia, the state decides how your assets are distributed. This is called intestate succession β€” and the results might surprise you.

Without a Will, you also lose the ability to:
β€’ Choose who raises your minor children
β€’ Name the person who manages your estate
β€’ Leave specific assets to specific people
β€’ Protect a loved one with special needs

✨ The state's plan is rarely your plan.
A valid Will ensures your wishes β€” not Georgia's default rules β€” guide what happens to your estate.

Letters Testamentary β€” The Executor's Golden Ticket πŸ”‘πŸ“‹

You've been named Executor of an estate. Now what? Before you can do almost anything β€” access bank accounts, sell property, or handle financial matters β€” you need one critical document: Letters Testamentary.

Letters Testamentary is an official document issued by the Georgia Probate Court that gives the Executor legal authority to act on behalf of the estate.

Without it, you cannot:
β€’ Access or close the deceased's bank accounts
β€’ Transfer or sell real estate
β€’ Handle investment accounts or retirement funds
β€’ Deal with creditors or claims against the estate

To obtain Letters Testamentary in Georgia, the court must approve the will as valid and formally appoint the Executor. The process and timeline can vary by county.

At Duckett Law LLC, we guide Executors and Administrators through every step β€” from filing with the Probate Court to final distribution.

✨ Being named Executor is an honor β€” but it's also a legal responsibility.
Let us help you do it right.

What Is Probate β€” And Should You Be Worried? πŸ›οΈπŸ“œ

The word "probate" often makes people nervous. But understanding what it actually is can take away a lot of that fear.

Probate is the legal process through which a deceased person's estate is administered in accordance with the terms of the person’s will β€” debts are paid and assets are distributed β€” under the supervision of the Georgia Probate Court. If there is no will, then the court-supervised process is intestate administration, and property is distributed to heirs according to the rules under state law.

Here's what probate or estate administration involves:
β€’ Filing the Will (or establishing there isn't one) with the court
β€’ Appointing an Executor or Administrator to manage the estate
β€’ Notifying creditors and settling valid debts
β€’ Distributing remaining assets to heirs

Not all assets go through probate. Life insurance with named beneficiaries, joint accounts, and assets held in a trust typically pass outside of probate entirely.

Probate in Georgia can take several months to over a year depending on the complexity of the estate. Having an experienced attorney guide the process makes a real difference.

✨ Probate doesn't have to be overwhelming.
With the right guidance, it can be a smooth and manageable process.

Is Your Family Home at Risk After You Pass? πŸ‘βš–οΈ

Many Georgia families don't know that the state can seek repayment of Medicaid nursing home benefits from your estate after you pass away β€” including going after your home. This is called Estate Recovery, and it can affect families who relied on Medicaid to fund nursing home care.

In Georgia, assets subject to Medicaid Estate Recovery can include:
β€’ The family home if it passes through probate
β€’ Bank accounts and assets held solely in your name
β€’ Property transferred without proper legal protections

The good news? With the right planning, you may be able to protect your home.

There are a variety of legal strategies that help you protect your assets β€” but only if done correctly and in advance.

At Duckett Law LLC, we help families understand their options before a crisis, not after.

✨ Your home is likely your most valuable asset.
Make sure it's protected for the people you love.
