What happens when the other side starts protecting its case before the victims have even left the scene?

David Craig shares the experience that convinced him his firm needed its own rapid response team. Instead of waiting for evidence to disappear or witness accounts to change, his team gets to work protecting clients and preserving critical information.

For David, the lesson was bigger than one case. If you want to compete at the highest level, you have to invest back into your firm and build the resources your clients need.

A payroll provider isn't just moving money to your team. They're handling obligations that can create a serious financial problem for your firm when they're not managed correctly.

In this episode of the Founding Partner Podcast, Jonathan Hawkins walks through what attorneys need to prioritize when launching a firm quickly including payroll, banking, malpractice insurance, client transitions, practice management systems and the infrastructure that keeps a new practice running.

How often are you verifying the systems you've entrusted to outside vendors?

What happens when clients want to follow you to your new law firm?

Jonathan Hawkins explains why the transition requires more than simply telling clients where you went. Client notices, new engagement letters, court systems, and notices of appearance all need attention so important details do not fall through the cracks.

When you are launching a firm unexpectedly, the goal is not to tackle everything at once. It is to know what needs to happen next.

📁 A law firm transition shouldn’t put the client in the middle.

When a client directs that their file be transferred, delaying the process can create more than administrative friction, especially when that delay could prejudice the client.

In this episode of the Founding Partner Podcast, Jonathan Hawkins discusses what both departing lawyers and law firms need to consider when handling client files, including transfers, copies, outstanding fees, and getting the client’s instructions in writing.

It’s one of several potential “landmines” that can arise when an attorney leaves a firm.

How does your firm make client transitions as seamless as possible when an attorney leaves?

A lawyer leaves a firm. The client follows. Who gets the file?

Jonathan Hawkins breaks down an issue that can become contentious during a law firm departure: client files belong to the client, not the attorneys.

If a client directs the firm to transfer their file, the firm generally needs to follow that direction. But that does not mean a departing lawyer can simply walk out with the files.

Notice, client direction, and proper transfer matter.

And when emotions run high, locking a departing lawyer out of files they need for an upcoming hearing can create problems for everyone, including the client.

This is legal information only, not legal advice. Rules can vary by jurisdiction and circumstance.

⚖️ There’s a difference between planning your law firm exit and competing with your current firm.

Lawyers can make logistical preparations for their next move, but Jonathan Hawkins explains why there’s an important line between preparing to leave and actively competing, soliciting clients, or marketing a new firm.

In this episode of the Founding Partner Podcast, Jonathan breaks down three critical issues surrounding lateral moves: notice to your firm, communication with clients, and handling client files.

For law firm partners and attorneys considering a move, understanding the sequence matters.

What do you think firms and departing attorneys most often get wrong during a lateral transition?
