We are currently getting a number of calls from permanent residents and conditional residents regarding the May 21, 2026, USCIS policy memo.

The memo is vague and intentionally unspecific. It is designed to cause fear, worry, and frustration in order to make legal immigration less pleasant so fewer people choose to immigrate. Thus, people's calls and worries and anxieties are understandable. However, at this time, we have no reason to believe that the new USCIS policies apply to immigration matters beyond adjustment of status. Therefore, there is currently no reason to believe that these policies apply to conditional residents or permanent residents in any legal manner whatsoever.

But, make no mistake. This is an attack on legal immigration; and, it's meant to cause a chill with regard to legal immigration across the board. President Trump and Stephen Miller have goals to stress you out and to bring your household anxiety. Do not let them win. If you are a permanent or conditional resident, enjoy travels and life. Worry when you need to worry so you prepare accordingly, but otherwise try to shut off the social media and the noise when you can. Instead, just speak with an attorney you trust to figure out if your worry is really worth your time. Take a walk in nature when you can.

"U.S. Citizenship and Immigration Services Will Grant ‘Adjustment of Status’ Only in Extraordinary Circumstances"

The USCIS policy memo from May 21, 2026, suggests unprecedented change to the application of U.S. law when it comes to lawful immigrants apply to adjust status. The USCIS policy memo is not very clear on a number of issues. It is not clear to whom the new policies apply. It is not clear to what extent the policies apply. We do not really even know what the exact new policies will be. At the very least, these are policies meant to cause worry and distress among immigrants and their families and to discourage them from apply for adjustment of status. At the most, they could be some of the most restrictive and negatively consequential immigration policies in generations.

It is also likely these policies will be found unlawful by the courts.

U.S. Citizenship and Immigration Services today announced a new policy memo reiterating the fact that, consistent with long-standing immigration law and immigration court decisions, aliens seeking adjustment of status must do so through consular processing via the Department of State outside of the....

Please do not provide information and/or money to people calling you on the phone, texting you, or emailing you. The government does not communicate with you like this, and USCIS will almost never ever call you. So, expect phone calls and text messages to be a scam. When in doubt, call an immigration attorney of call USCIS at 1-800-375-5283.

Con artists posing as ICE agents and immigration officers are using WhatsApp and fake court hearings to bilk vulnerable people out of their savings with empty promises to fix immigration problems. As mass deportations continue, scam complaints soar.

Be aware. I have had more than one client pay someone $500 for promises that they would be give a permanent resident card. Scammers texted them fake USCIS websites and fake updates.

A reminder: USCIS almost never calls you. If someone saying they are from the government calls you, talk to an attorney before paying them any money via wire or Zelle or over the phone.

Fake judges. Fake lawyers. Real deportations.

Some bad news. The Trump Administration is ending the automatic work extension rule for call I-765 EAD categories. This means once your work authorization expires, you will be not be lawfully allowed to work until your I-765 work authorization renewal is approved. If this new rules stands, I would recommend filing your work authorization renewal applications at least 5-6 months before your work authorization expires so that you do not have a gap in employment.

USCIS interim final rule ending the automatic 540-day extension of employment authorization documents (EADs) for all renewals filed on or after 10/30/25. The rule applies to all categories previously eligible for the extension. Comments are due 12/1/25. (90 FR 48799, 10/30/25)

We are getting lots of calls. There is currently no way to pay the annual asylum fee. As usual, President Trump likes to create chaos by talking before there is actually any plan. The Immigration Courts and government employees currently have no idea how this fee is even going to work. They have receiced no guidance and no training. Systems are not in place. Trump is just trying to stress everyone out and create chaos.

Just stand by and wait for meaningful updates from the government. This is just mostly noise at this time.

The Trump administration's lack of clarity about when and how to pay new fees sparked chaos and misinformation among immigrants with pending asylum applications.
