Traumatic brain injury cases are among the most complex to value, because the future needs are uncertain, evolving, and expensive. A strong life care plan for a TBI client should include:
✅ Neuropsychological and neurological care projections
✅ Cognitive rehabilitation and speech/occupational therapy
✅ Home modification and attendant care costs
✅ Vocational impact (separate evaluation)
✅ Realistic, location-based cost sourcing

While a thorough life care plan defines the scope of future care, it is only half of the equation. To protect your client's position, a corresponding Forensic Economic Report must be secured to handle the critical discount rates and present value calculations.

A life care plan in a medical malpractice matter must:
✅ Be grounded in the specific medical record, not generic injury categories

✅ Address the specific complications the error created
✅ Stand up against defense medical experts who will argue care was unnecessary

Functional Capacity Evaluations aren't only for personal injury cases. In divorce proceedings where one spouse contests their ability to work due to claimed physical limitations, an FCE provides the objective, standardized assessment the court needs.

What an FCE in a divorce context establishes:
✅ The individual's actual physical tolerance for work activity
✅ Consistency of effort and reliability of testing
✅ Work-related limitations supported by functional, not just subjective, findings

Many attorneys focus solely on the life care plan, but a comprehensive damages picture requires both a Life Care Plan and a Forensic Economic Report to account for essential factors like discount rates and present value calculations.
