This man was imprisoned 23 years ago, when he was 19 years old, for selling a small amount of co***ne to an undercover officer. It was his first offense and he received a sentence of 20 to 40 years. The conditions of his confinement were inhumane. He spent over 6 years in solitary confinement. He was denied contact visits with his family for more than 13 years. He spent almost all of his sentence alone in a cell for 23 years. He has MS and related mental illnesses. The MDOC literally tortured this man, for years. An amazing judge and a tough but humanitarian prosecutor took notice of the great injustice that had taken place and Joel was released from his decades long nightmare. He is back home with his family. We can and must do better!! There are hundreds of others like Joel who are languishing in a solitary cell. Please help me give them a voice!!

We support Illinois Governor J.B. Pritzker’s statement following the tragic shooting in Highland Park, IL:

“Our founders carried muskets, not assault weapons,” Gov. Pritzker said. “And I don’t think a single one of them would have said you have a constitutional right to an assault weapon with a high-capacity magazine — or that that is more important than the right of the people who attended this parade today to live. Yes, I’m angry. We, as a nation, deserve better.”

We at Margolis & Cross were devastated to hear of the senseless and horrific shooting in Highland Park this past weekend. This tragedy, which left 7 people dead and many more injured, is yet another reason for our nation to reconcile our interpretation of the United States Constitution’s 2nd Amendment. Simply put, there must be logical, sensical gun control legislation enacted in this country. It is our firm’s belief that the framers of our constitution did not intend to protect an individual’s right to purchase a weapon of war and belligerently end the lives of countless innocent people. May the victims of this atrocity rest in peace.

On June 29, 2022 a federal jury acquitted our client, Dr. Christopher Russo, of all eight charges against him in United States v. Rajendra Bothra et al. In 2018, federal prosecutors brought a 54 count indictment alleging the defendants billed for medically unnecessary procedures in exchange for prescription pain medications--accusations which proved to be patently false and unsubstantiated. After a seven-week trial, the jury found our client not guilty on all counts, vindicating Dr. Russo and his co-defendants, and sending a resounding message to the government. This was an unjust prosecution from the start, and we were honored to be part of such a tight-knit defense team.

In May 2022, our firm settled a case where we represented four individuals whose rights were violated after being committed to a psychiatric hospital after they pled Not Guilty Reason of Insanity (NGRI). Our clients’ substantive and procedural due process rights were repeatedly violated, as were their protections afforded mentally ill individuals under the Americans with Disabilities Act (ADA) and the Rehabilitation Act. After years of contesting liability and forcing our office to litigate these complex claims in federal court, the State of Michigan ultimately settled the case and agreed to a comprehensive overhaul of the state’s psychiatric inpatient care system related to its protocol for NGRI patients. The State of Michigan continues to be monitored under a consent degree in order to ensure adherence to terms that provide the mentally ill basic and necessary constitutional rights. The case continues to be litigated against a separate defendant, who assisted the State in depriving these disabled individuals of their rights under the law. We hope to take that case to trial so a Michigan jury can hear the truth of how our government and related community mental health service providers mistreat our most vulnerable citizens.

We are proud to have received a $1,000,000 settlement from the State of Michigan on behalf of our clients and to have the State policed under the terms of the consent decree for the foreseeable future.
