Probate is the court-supervised process that takes place after someone passes away — even if they had a will. The person responsible for carrying out their wishes is called the executor (if there’s a will) or administrator (if there isn’t). Both have specific legal obligations to follow.
You may need to open a probate case if the estate is worth more than a certain amount or includes real estate. If someone is requesting Letters of Office or Letters of Administration, that’s a sign probate is required to move forward.
