What the Arizona Clergy Reporting Ruling Actually Means

The Arizona Supreme Court recently ruled that clergy may be exempt from reporting suspected child abuse when they learn about it through a confidential religious communication or confession and determine that keeping it confidential is reasonable and necessary under their religion.

But there are important limits to understand.
🔹 The ruling does not mean clergy can ignore child abuse in every situation. The exemption applies to qualifying confidential communications or confessions.
🔹 The ruling centers on religious confidentiality. The Court said judges and juries cannot decide whether a particular religious practice is “reasonable and necessary” within that faith.
🔹 The decision does not erase the seriousness of child abuse. In this case, a father confessed to an LDS bishop that he had sexually abused his daughter. The abuse was not reported, and he continued abusing his other children for years.
🔹 The ruling has raised serious concerns among survivor advocates. Critics argue that protecting confidential religious communications can create situations where children remain at risk while abuse goes unreported.

Religious freedom is a fundamental constitutional protection. So is the protection of children from abuse.

The difficult question is where those protections intersect, and what safeguards are available when a child may be in danger.
