A Lady Bird Deed, also known as an Enhanced Life Estate Deed, is a document many Floridians use to avoid probate when it comes to their real property.
A Lady Bird Deed allows the current owner to have complete use and legal control of the property during the owners lifetime while naming beneficiaries who will receive the real property automatically upon their passing.
The benefits of a Lady Bird Deed include: the ability to avoid the probate process as it relates to the transfer of title to your real property, low cost, and preservation of your homestead benefits and Medicaid Eligibility. The current owner can still sell, convey, mortgage, lease, and manage the property freely without the permission of the remainder beneficiaries. This allows the property owner to change their mind at any point during their lifetime and enter into a new deed to change the beneficiaries or cancel the Lady Bird Deed entirely.
