Allstate agreed to a settlement of at least $2.2 million to resolve claims that it failed to fully pay New Mexico policyholders after incidents with uninsured motorists.

The class action against Allstate for return of premiums and/or car crash bodily injury readjustment without offset is open for class claims.

The class action website will help class members to understand their legal rights. Offset claims may vary from $25,000 to $1 million.

This class action includes more than 250,000 class members and notice has been sent out via email. A paper claim can be requested from the claims administrator.

Today in the Chama courtroom at the United States District Courthouse for the District of New Mexico, the Honorable Judge Ritter approved the class action settlement, Martin/Martinez vs. Progressive, Case No. 19 CV 0004, allowing claims to be processed and monies to be distributed to thousands of claimants who may have been insured by Progressive Auto Insurance and their entities.

When describing this class action Judge Ritter noted that this was a “remarkable” resolution for all parties.

There is still time to submit a claim. The deadline is August 10 and if you were insured by Progressive from 2004 to 2022 you may be an identified class member and are entitled to submit a claim.

Hello fellow New Mexicans. There is still time to submit your claim to be included in the auto insurance class action settlement with Progressive Auto Insurance.

Although Flo will not be personally writing you a check, Progressive has agreed to not apply the underinsured motorist offset to drastically reduce benefits that were paid for.

Progressive has also agreed to return a portion of UM/UIM premiums for class members that may not have been seriously injured in a car crash.
