Finding out that something crosses a property boundary does not automatically tell you how the matter should be resolved.

You first need to understand what is encroaching, how significant it is, how long it has been there and even which property is actually crossing the boundary.

A fence crossing the line is a very different situation from part of a building or foundation crossing it.

The survey gives you important information. What happens after that depends on the circumstances.

Runoff, leaking pipes, overflowing tanks and changes to surrounding land can all create different problems. Document what is happening as it happens, then have the source and drainage conditions properly assessed.

The clearer the evidence, the easier it is to understand what you're dealing with and what should happen next.

It may look like a simple line on the ground, but determining a legal boundary involves much more than following one bolt, peg, or boundary mark.

When a mark has been moved, disturbed, or no longer matches the available records, the answer cannot be based on that mark alone.

A proper boundary determination considers the overall body of evidence—including survey plans, reference points, existing marks, and available records.
