Lee & Lee is pleased to have acted for WCEGA Plaza and Tower in HC/RAS 5/2026 which resulted in the High Court's decision that the ‘2% proxy rule’ (which limits the number of subsidiary proprietors a proxy holder can represent via proxy) does not apply to representatives appointed by subsidiary proprietors which are companies.

In the closing hours of 3 July 2025, the Ministry of National Development, Ministry of Finance and Monetary Authority of Singapore announced that by midnight of the following day, a new seller’s stamp duty (“SSD”) regime would be put in place (“the media release”). This comes after 8 years of the previous regime, in which the SSD holding period was pegged at three years, with rates of between 4 per cent and 12 per cent.

Under the new SSD regime, implemented as of 4 July 2025, the SSD holding period is raised to four years, and the SSD rates increased by 4 percentage points for each tier of the holding period. For sellers of private properties with more than four years after the date of purchase, no SSD shall be payable.

Recently, our firm hosted an event titled “Innovations in Trust, VCCs, and Real Estate Investments in Singapore”. The event explored the common tools used in the area of private wealth and how these tools have evolved over the years to adapt to the laws and regulations of Singapore.

Our esteemed guest, Mr. Sunny Leow, Head of Trust Administration at British & Malayan Trustees Limited, also gave an eye-opening talk regarding legacy cases on trusts holding real estate in Singapore.

Thereafter, we had an interactive panel discussion with the following panelists:
• Mr. Joel Teo, Partner from our Corporate Department;
• Mr. Timothy Loh, Partner from our Real Estate Department; and
• Mr. Sunny Leow, Head of Trust Administration, British & Malayan Trustees Limited.

What can MCSTs do when unit renovations are suspected to have affected common property or breached the BMSMA, but the owner refuses to let the MCST inspect the unit? The MCST of Highland Centre obtained an order from the Strata Titles Board, later upheld by the High Court, for access to the unit to determine if remedial / rectification works are necessary. This case update discusses both decisions, including the test set out by the High Court for the granting of access.
