Fervent Chambers LLC successfully defended our client was sued for defamation by a former practising lawyer. In its judgment delivered on 21 September 2026, [2026] SGDC 311, District Judge Evan Ng dismissed the action in full.
The claim concerned two alleged defamatory publications: a police report and a complaint to the Law Society of Singapore, arising from concerns about our client’s late mother’s will. The complaint questioned the claimant’s professional status when she witnessed the will.
Our defence succeeded on three key points.
1. The police report: the pleaded case had to be proved.
The police report described in the statement of claim was not proved. The report produced in evidence did not correspond to the pleaded report, and the words alleged to be defamatory had not been properly pleaded. Neither report could therefore support liability.
2. The Law Society complaint: qualified privilege applied.
Although the Court found that the complaint conveyed a defamatory meaning, it upheld our client’s defence of qualified privilege. As a beneficiary under the will, he had a legitimate interest in raising his concerns. The Law Society had a corresponding interest in receiving them.
3. Express malice was not established.
The Court considered our client’s searches and enquiries before making the complaint. His failure to exhaust every possible avenue of verification did not, without more, establish malice. The evidence also did not establish a dominant improper motive or publication beyond the Law Society’s complaints process.
For our client, this meant successfully defending proceedings brought by someone with legal training and her own legal representation.
