Alarming Case Pendency: Can Mediation Restore Balance?

With over two million cases pending, every delayed verdict means real people, families, and businesses waiting years for resolution.

Recently, 24,000+ cases were shifted from the Sindh High Court to district courts under the Sindh Civil Courts (Amendment) Act, 2025, a move to ease pressure, but one that reminds us how deeply delay affects access to justice.

Mediation offers a way out: faster, confidential, and cost-effective. It helps parties talk, resolve, and move forward without waiting years for a verdict.

At MICADR, Pakistan’s first High Court–recognized ADR Centre, we are redefining the pace of justice. As the country’s largest ADR institution, we bring together 150+ internationally accredited mediators and have successfully mediated over 400 cases with a 70% resolution rate. Through every case, we’re building a culture where disputes end through dialogue, not delay. Because justice loses its meaning when it comes too late.

MICADR proudly represents Pakistan at the Regional ADR Symposium 2025 in Colombo, Sri Lanka - joining leading ADR institutions from across Asia to shape the future of arbitration and mediation.

This week in Colombo, Sri Lanka, ADR leaders from across Asia are convening for the Regional ADR Symposium 2025, organized by the Commercial Law Development Program and The International ADR Center, Sri Lanka.

The Symposium provides a vital platform for dialogue on the evolving ADR landscape, institutional reforms, and emerging global trends. Over two days, representatives are engaging in closed-door sessions to exchange knowledge, discuss best practices, and explore opportunities for regional cooperation.

Our Co-Founder, Ms. Sarha Rasheed, is presenting on Pakistan’s ADR ecosystem — which first gained recognition through the Sindh High Court and the Federal Government. MICADR stands as one of Pakistan’s first recognized ADR institutions, building an ecosystem that integrates mediation and arbitration into the justice system while also training mediators, lawyers, and judges across the country.

The Symposium has brought together a distinguished group of institutions from Malaysia, Thailand, Nepal, Maldives, Hong Kong, Singapore, India, Sri Lanka — and Pakistan through MICADR.

MICADR is showcasing its journey of strengthening ADR in Pakistan: from securing judicial and governmental recognition, to establishing the country’s first private dedicated ADR center to gain formal recognitions, to developing a culture of dispute resolution rooted in efficiency, accessibility, and credibility.

We extend our gratitude to CLDP and IADRC for convening this important initiative, which strengthens regional collaboration and reflects a shared commitment to advancing ADR.

MICADR is honored to stand among regional counterparts, representing Pakistan on this international stage, and contributing to the collective vision of making ADR a trusted pathway for resolving disputes.

De-escalation & Resolution: Building a Culture Beyond Conflict

At MICADR, we are deeply committed to promoting peaceful, constructive approaches to conflict. Recently, an incident involving the physical assault of a clothing store salesperson by a customer has brought renewed urgency to our mission.

While the employee displayed commendable restraint during the altercation, this unfortunate event highlights a growing concern—how quickly matters can escalate when emotions override reason.

Why Resolution Matters

In any setting—whether commercial, workplace, or personal—tensions will arise. But resolution is not about “winning” a disagreement. It is about listening, understanding, and finding a path forward without damage to people, reputations, or relationships.

De-escalation is not weakness. It is the active choice to break the cycle of retaliation, restore dignity to all parties involved, and open a space for resolution.

The Role of ADR

Our centre exists to support such outcomes. We provide trained mediators and conflict resolution processes that prioritize dialogue, empathy, and fairness. Whether between customers and businesses, employers and staff, or among peers—ADR is a practical, proven alternative to conflict escalation.

Let this incident serve as a reminder and a call: We all have a role to play in fostering environments where respect prevails over reaction.

Resolution is not just possible—it’s essential.

Musaliha International Center for Arbitration & Dispute Resolution (MICADR)
successfully concluded another IMI-accredited Mediation Skills Training — this time in Islamabad.

The training was led by our expert faculty: Mr. Sohail Khoja, Ms. Fehmida Ajanee, Mr. Muhammad Shahzar Ilahi and Ms. Sarha Rasheed. Together, they facilitated an intensive and highly interactive program focused on developing practical mediation skills and deepening participants’ understanding of the mediation process.

The cohort comprised lawyers, public sector professionals, academics, and representatives from civil society — all committed to advancing the role of mediation in Pakistan’s justice system.

It was particularly encouraging to see consensus emerge on the need to institutionalize mediation as a key tool to reduce case pendency and promote a more accessible, efficient, and people-centered approach to dispute resolution.

MICADR remains dedicated to building ADR capacity nationwide and upholding international standards in mediation training and practice.

Lahore University of Management Sciences-LUMS just Sent a Powerful Message to Pakistan’s Legal System — Mediation is Not the Future. It’s the Now.

From 30th May to 3rd June 2025, the Legal Aid Society and MICADR had the honour of delivering a landmark International Mediation Institute (IMI) Certified 40-hour Mediation Skills Training at the Shaikh Ahmad Hassan School of Law (SAHSOL), LUMS — Pakistan’s leading law school at one of the country’s most prestigious universities.

What made this training historic was not just its global accreditation, but who chose to be part of it. Among the participants were Dr. Sadaf Aziz, Dean of SAHSOL, and Dr. Tariq Jadoon, Provost of LUMS, alongside senior law school faculty and members of the senior management at LUMS.

Delivered by Sohail Khoja (Chief Trainer), Fehmida Ajanee (Chief Assessor), Shahzar Ilahi, and Sarha Rasheed, the training brought together a powerful blend of theory, practical skills, and live simulations. From complex commercial disputes to emotionally charged family conflicts, participants were guided through real-world scenarios to develop the core competencies of interest-based negotiation, active listening, neutral facilitation, and ethical resolution.

In her reflections, Dr. Sadaf Aziz described the experience as “professionally transformative”, sharing how the program had fundamentally reshaped her perspective on dispute resolution. Dr. Tariq Jadoon, Provost of LUMS, emphasized the strategic value of this training in shaping the kind of law graduates Pakistan needs today; those who can resolve conflict, not just litigate it.

This training takes place against the backdrop of a major shift in Pakistan’s legal landscape. With the Supreme Court of Pakistan initiating institutional referrals to mediation, over 40 superior court judgments affirming ADR, and Pakistan’s signing of the Singapore Convention on Mediation, the country is entering a new era of justice, one rooted in dialogue, not delay.

LUMS has now firmly positioned itself at the center of this national movement. The university is no longer just preparing lawyers, it is preparing peacemakers, facilitators, and credible dispute resolvers. With a cohort of internationally accredited mediators now in-house, SAHSOL is equipped to teach mediation, integrate it into its curriculum, and host mediations at the university level.

As the legal, commercial, and investor communities demand faster, more cost-effective dispute resolution pathways, this move by LUMS sends a bold signal: Pakistan is ready to lead the region in institutionalizing mediation.

We are proud of this growing partnership between LUMS, Legal Aid Society and MICADR, and are excited about what comes next.
