🏆 LITIGATION VICTORY:

Dismissal Secured via Strict Application of Jurisdictional Doctrine!

Atty: / Engr. John Daniel Tubillo Valencia counsel for the defendant.

Failing to state a property's assessed value is a fatal mistake.

In this case, the initiatory pleading regarding real property completely omitted its assessed value. The Court strictly applied the established doctrine, ruling:
"Jurisdiction over a real action is determined based on the allegations in the complaint of the assessed value of the property involved. The silence of the complaint on such value is ground to dismiss the action for lack of jurisdiction..."

🔍 Understanding the Doctrine
In property disputes (real actions), jurisdiction is determined strictly by the government's tax assessment value. This number dictates whether a case belongs in the lower court (MTC) or the higher court (RTC).

The court’s legal power to hear a case must be clear on the very face of the complaint. A judge cannot guess, assume, or investigate the value on their own.

Silence = Dismissal

If the paperwork is silent on this value, the court lacks the legal basis to move forward and must dismiss the action.
