Family Mediation βš–οΈπŸ‡΅πŸ‡­


The Supreme Court (SC) En Banc has approved the Rule on Family Mediation (Rule) in a resolution dated November 5, 2024 in A.M. No. 24-02-06-SC. This initiative aims to address the emerging need for family mediation, both domestic and international, enhance the efficiency of family courts, reduce court backlogs, and promote the best interests of the child. The Rule also introduces innovations in dealing with family cases.

The Rule describes family mediation as a process in which a mediator, acting as an impartial third party, facilitates the resolution of family disputes and helps the parties in reaching voluntary agreements.

Family mediation, a non-adversarial process, should include children and give them a chance to share their thoughts on issues that impact them. The process must focus on what is best for the child and the family.

The Rule is limited to suits between spouses; parents and children; other ascendants and descendants; siblings; relatives within the fourth civil degree of consanguinity (by blood) or affinity (by marriage); and parties in a common-law, dating or sexual relationship, former or present.

The Rule took effect 15 calendar days after publication. It was published in a newspaper of general circulation on December 14, 2024.

Following the Rule’s approval, the Committee, together with the Philippine Judicial Academy, shall prepare for the Application, Training, and Accreditation of Family Mediators.

Hindi maaaring suspendihin ng isang Christian school ang isang dalagang g**o dahil sa pagbubuntis.

Ito ang naging desisyon ng Korte Suprema nang idineklara nitong illegal ang pagsuspinde ng Bohol Wisdom School (BWS) sa isang g**o dahil sa pagkakabuntis nang hindi pa ikinakasal.

Binigyang-diin ng Korte Suprema na ang premarital sexual relations sa pagitan ng dalawang single and consenting adults na humahantong sa pagbubuntis ay hindi imoral. Walang batas na nagbabawal dito at hindi rin ito sumasalungat sa anumang pangunahing patakaran ng Estado na makikita sa Konstitusyon.

Nilinaw ng Korte na sa ilalim ng batas, ang pamantayan ng moralidad na naaangkop sa lahat ay pampubliko at sekular, hindi base sa relihiyon.

Ang pampubliko at sekular na moralidad ay tumutukoy sa pag-uugali na ipinagbabawal dahil sa mga nakakapinsalang epekto nito sa lipunan ng tao sa halip na batay sa mga paniniwala sa relihiyon.

Dahil hindi maituturing na imoral ang pagbubuntis ng g**o, hindi ito wastong batayan para sa kanyang pagkakasuspinde.

Inutusan ng Korte ang BWS na bayaran ang g**o ng backwages at mga benepisyong dapat bayaran sa kanya noong panahon na siya ay nasuspinde.

Ang Desisyon ay mula sa First Division ng Korte Suprema, na isinulat ni Associate Justice Ricardo R. Rosario.

The Supreme Court has ruled that foreign divorce decrees do not require judicial proceedings abroad to be recognized in the Philippines.

The Court ruled that Filipinos who were previously married to foreigners can seek judicial recognition of their foreign divorce under Article 26, paragraph 2 of the Family Code. The type of divorce, whether administrative or judicial, does not matter. As long as the divorce is valid under the foreign spouse's national law, it will be recognized in the Philippines for the Filipino spouse.

The Court emphasized that Article 26(2) aims to prevent a situation where a foreign spouse can remarry while the Filipino spouse remains bound by the marriage.

The Court also clarified that under Office of the Court Administrator (OCA) Circular No. 157-2022-A, the OCA’s compilation of foreign divorce laws serves only as a preliminary reference for courts but does not dispense with the requirements of proving foreign divorce laws under the Revised Rules on Evidence.

Ayon po Korte Suprema, ipinapalagay daw po ng batas na intensyunal or sinasadya ng lalaki ang pagdulot ng emosyunal na paghihirap sa isang babae kapag ang nasabing lalaki ay nangangaliwa or nakikipag mabutihan sa ibang babae.

Matagal na pagliban ng asawa, maituturing na Psychological Incapacity ayon sa Korte Suprema

Ang matagal ng pagkawala ng asawa sa kanilang pamamahay ay maaring ituring na katibayan ng psychological incapacity na basehan para ipawalang-bisa ang kasal.

Sa Desisyon na isinulat ni Senior Associate Justice Marvic M.V.F. Leonen, pinawalang-bisa ng Korte Suprema ang kasal nina Leonora at Alfredo matapos mapatunayan na tumanggi si Alfredo na magbigay ng pinansyal na suporta sa kanyang pamilya at tuluyang iniwan si Leonora at kanilang mga anak simula 1994.

Napatunayan ding nagkaroon ng relasyon si Alfredo sa ibang mga babae.

Ayon sa Korte Suprema, nakasaad sa Article 68 ng Family Code na obligasyon ng mag-asawa na magsama, magpakita ng pag-ibig, respeto, at katapatan sa isa't isa, at magbigay ng tulong at suporta.

Ang pangangaliwa ni Alfredo, ang kanyang matagal na pagkawala sa tahanan at ang hindi pagbibigay ng suporta sa kanyang misis at anak ay nagpapakita na hindi nya naiintindihan ang kanyang mga obligasyon bilang asawa at ama.
