THE FIRST DECISION OF THE SUPREME COURT ON "TOKHANG"

For the first time, the Highest Tribunal, in a decision released the other day, ruled that the killing of suspected drug pusher by drug police operatives while conducting "Tokhang" is not murder.

Oplan Tokhang, short for "Tuktok-hangyo, was adopted by the Philippine National Police during the previous administration in its unrelenting campaign against illegal drugs. It refers to the operation of the PNP where operatives knock on a suspected drug trafficker or drug addict's home to persuade them to surrender and stop their illegal activities.

In September, 2016, a group of armed police officers barged into the house occupied by spouses Luis and Mary Ann and their three young sons in Caloocan City. The operatives proceeded to the room where Luis was situated while shouting "mga pulis kami, searching lang po." One of the operatives was pointing his gun at Luis' head while on his knees. His son, Gabriel was pulling at the police pleading "Sir wag po. Papa ko yan. Ano bang kasalanan namin? Wala kaming ginagawang masama."

Mary Ann ran outside the house to ask for help from the barangay. While running away, she heard several gunshots coming from their house. She was informed later that her husband Luis and son Gabriel were brought to hospital where they expired due to gunshot wounds.

Mary Ann filed complaints for two counts of murder and robbery against nine police officers. She also filed administrative complaints against them. Both complaints were filed with the Ombudsman.

The police officers denied the charges saying that they were conducting a legitimate buy-bust operation. They said that they coordinated with the PDEA before the operation.

After preliminary investig*tion, the Ombudsman rendered a resolution dismissing the murder and robbery complaints. It however recommended the filing of Homicide against four police officers only. The complaints against other respondents were dismissed.

Mary Ann questioned the indictment for homicide against the said police officers. She argued that they should be charged with murder citing the existence of treachery and evident premeditation, among others.

The Supreme Court upheld the Ombudsman resolution.

Was there treachery in the killing of Luis and Gabriel?

There was no treachery. When the police officers entered the house, they declared their purpose and introduced themselves as police operatives. They pointed their guns at the victims. Thus, it cannot be said that the act of using their fi****ms was sudden and unexpected. Moreover, the shooting had been made at a spur of the moment brought about by Gabriel's attempt to obstruct his father's arrest.

Was there evident premeditation?

There was no evident premeditation. The police operation carries with it the presumption of regularity in the performance of their official duty. There was no clear evidence that the police operation was conceived to kill the victims. The mere fact that the killings were committed during a planned police operation does not by itself constute prima facie evidence of evident premeditation.

MANONG: Ay iyong manok mo na si Charlie ay namatay.

ATTY: Ha? Si Charlie? Naku manong panderby natin ‘yon. Bakit namatay?

MANONG: Kasi eh, nakakain ng s**a ng kabayo. Sinamaan agad. Aba’y nakita ko na laang e kumikisay na eh.

ATTY: O eh bakit ho hinayaan ninyong kumain ng s**a ng kabayo? At saka bakit ho may s**a ng kabayo? Aling kabayo ang nags**a?

MANONG: Ay iyong si Sir Galahad, Atorne.

ATTY: Sir Galahad? Naku! Bakit ho naman nags**a? Tumawag na ba kayo ng beterinaryo?

MANONG: Hinde, kasi nahulasan na. Mangyari eh, ginamit naming panghila ng kariton. Ay siya, napakahina pala noon kapag may karga, dalawang biyahe pa laang eh gulapa na agad.

ATTY: O eh bakit naman ninyo ginamit na panghila ng kariton? Bisiro pa lang ho ‘yon. Tinawaran nga sa akin ni Gobernor ng 100 thousand, hindi ko binigay dahil anak yan ng 2 time champion tapos gagamitin niyo na panghakot. Ano ho ba hinakot niyo?

MANONG: Drum ng tubeg.

ATTY: O e bakit ho naghahakot kayo ng tubig, may gripo naman?

MANONG: Ay hinde kaya ng hose sa gripo eh. Kung ‘di namin naagapan ng buhos ay baka natupok ang bahay mo.

ATTY: Ho? Nasunog ang bahay ko?
MANONG: Naagapan nga, bandang salas laang ang dameyds.

ATTY: Ay bakit ho nagkasunog?

MANONG: Kase di g*t sabi niyo ay parating magbukas ng bintana para puma*ok ang hangin at sa gan-on ay palaging presko sa loob ng bahay?

ATTY: Oho, ay bakit ho pagmumulan ng sunog iyon?

MANONG: Eh kase ‘yong hangin, nahipan ‘yong kurtina, kaya ‘yong kurtina nang sumagi sa kandila, naglagablab.

ATTY: Ho?! Eh bakit ho gumagamit pa kayo ng kandila? May brown out ba? Kung mayroon, may flashlights naman diyan! Bakit nagkandila pa kayo?

MANONG: Aba, Atorne, huwag ka namang sumigaw. Kung hindi kami gagamit ng kandila, napakalaking kabastusan naman sa nakaburol. Ako naman ang hinde papayag sa diskarteng iyan!

ATTY: Burol? Bakit ho may burol? May patay?

MANONG: Eh kasi Atorne, sagsag ang mga akyat-bahay dine ngay-on. Kaya ako eh laging bitbit ang shotgun. Noong isang gabi, nagkahulan ang mga a*o.

ATTY: O ano hong nangyari?

MANONG: Balisa ang mga a*o, kase nga may tao. Ito namang tatay niyo biglang susulpot. Dis oras ng gabi, walang pasabi. Sinita ko, hindi sumagot eh, e di pinutukan ko. Malamang Sabado ang libing. Hihintayin laang kayo.
